"On Thursday, Rep. Anthony Weiner (D-N.Y.) called on 55 Republican adversaries of the public option to give up their government-funded health insurance. The congressman argued that it is hypocritical for Senate and House members receiving "government-administered single-payer health care -- Medicare" to oppose making such coverage available to the American public.

"Even in a town known for hypocrisy, this list of 55 Members of Congress deserve some sort of prize," Weiner wrote. "They apparently think the public option is ok for them, but not anyone else."

Weiner, a member of the Health Subcommittee and co-chair of the Caucus on the Middle Class, has been a strong advocate of the public option. In recent weeks, he has challenged his own party, as well as President Obama to ensure that the final health bill includes an affordable public insurance plan for Americans.

A press release from Weiner's office identifies the congressional recipients of Medicare that he thinks should give up their government-funded insurance plans. The list includes Senate Finance Committee members Sen. Chuck Grassley (R-Iowa) and Sen. Mike Enzi (R-Wyo.), part of the Gang of Six that helped shape health care reform."

"Although the Freedom From Religion Foundation membership doesn't believe in prayer, especially government prayer, its federal lawsuit against the National Day of Prayer now "has a prayer."

U.S. District Judge Barbara Crabb of the western district of Wisconsin, in an opinion and order issued on Tuesday, denied motions to dismiss the Freedom From Religion Foundation's far-reaching legal challenge of National Day of Prayer proclamations. Denied were motions to dismiss filed by defendants Pres. Barack Obama, press secretary Robert Gibbs and Shirley Dobson, of the National Day of Prayer Taskforce.

"We are absolutely delighted that the courthouse door has not been slammed on the Foundation, and that we will be permitted to plead our significant case," said Dan Barker and Annie Laurie Gaylor, Foundation co-presidents.

Also seeking dismissal of the Foundation challenge was Pat Robertson's legal arm, the American Center for Law & Justice, which filed an amicus brief on behalf of 31 members of Congress.*

The federal government claimed that the "National Day of Prayer has a secular purpose." The U.S. Attorney General's office "trotted out everything but the kitchen sink in attempting to rationalize this union between government and religion," Gaylor said.

"Most insulting was the government's patently false claim that 'the tradition of a National Day of Prayer dates to the founding of our country,' " added Barker.

Congress enacted a law in 1952, at the behest of Rev. Billy Graham, requiring the president to issue an annual prayer proclamation. Congress claimed in the legislative record that the founders prayed during the Constitutional Convention that adopted the secular Constitution.

"This is absolutely untrue, and the White House brief perpetuates this myth, and makes many other claims based on bad history," said Gaylor. "We're going to set the record straight."

Motion to dismiss AIG-Shariah lawsuit DENIED

US District Ct of Michigan denies USG's motion to dismiss AIG-Shariah lawsuit

"In an extremely well-written and soundly analyzed opinion, Judge Lawrence P. Zatkoff of the US District Court for the Eastern District Court of Michigan, has denied the U.S. government's motion to dismiss the lawsuit filed by Kevin Murray. (The full opinion may be downloaded above from this entry's unique url.) Mr. Murray, who is represented by legal counsel David Yerushalmi and the Thomas More Law Center (Richard Thompson and Robert Muise), filed a federal complaint against the Treasury Secretary, representing the U.S. Treasury, and the Federal Reserve Board alleging that AIG's promotion of Shariah in its Shariah-compliant insurance products violates the Establishment Clause because the federal government owns and controls 80% of AIG and AIG's actions have become the government's.

The government filed its motion to dismiss making two arguments. One, Mr. Murray, as a former combat Marine, practicing Catholic, and tax payer, did not have standing to even bring this lawsuit. Two, even if he did have standing, the government acted in buying AIG without any intent to promote or become involved in religious questions.

The Court spent much of its opinion reciting the law on the narrow exception to the no-tax-payer-standing rule. That exception is triggered in a claim of a violation of the Establishment Clause and when there is a specific legislative grant for spending that implicates the First Amendment. The Court carefully reviewed all of the relevant case law and found the argument made by Messrs. Yerushalmi and Muise in their brief persuasive.

On the second issue, the Court put together all of the facts as presented by the Plaintiff's brief and concluded:

"In this case, the fact that AIG is largely a secular entity is not dispositive: “The question in an as-applied challenge is not whether the entity is of a religious character, but how it spends its grant.” Kendrick, 487 U.S. at 624–25 (Kennedy J., concurring). The circumstances of this case are historic, and the pressure upon the government to navigate this financial crisis is unfathomable. Times of crisis, however, do not justify departure from the Constitution. In this case, the United States government has a majority interest in AIG. AIG utilizes consolidated financing whereby all funds flow through a single port to support all of its activities, including Sharia-compliant financing. Pursuant to the EESA, the government has injected AIG with tens of billions of dollars, without restricting or tracking how this considerable sum of money is spent. At least two of AIG’s subsidiary companies practice Sharia-compliant financing, one of which was unveiled after the influx of government cash. After using the $40 billion from the government to pay down the $85 billion credit facility, the credit facility retained $60 billion in available credit, suggesting that AIG did not use all $40 billion consistent with its press release. Finally, after the government acquired a majority interest in AIG and contributed substantial funds to AIG for operational purposes, the government co-sponsored a forum entitled “Islamic Finance 101.” These facts, taken together, raise a question of whether the government’s involvement with AIG has created the effect of promoting religion and sufficiently raise Plaintiff’s claim beyond the speculative level, warranting dismissal inappropriate at this stage in the proceedings."

We reached out to Messrs. Yerushalmi and Muise in a conference call. They both were quite obviously pleased by the well-reasoned opinion. They also said, almost in perfect unison: "There is not a fact in the complaint we cannot prove." Mr. Yerushalmi added, "This case is going to send a loud and reverberating alarm in Washington and in the financial world which is now running full speed and blindly to embrace Shariah-compliant finance."

When the case was first filed, arm-chair First Amendment lawyers (meaning law professors who opine while gathering wood splinters writing arcane law review articles and shotgun blog entries) almost unanimously concluded this case had zero chance to survive a motion to dismiss. Turns out they were wrong. Way wrong.

Indeed, Thomas C. Baxter, Jr., the legal counsel to the New York Federal Reserve, was a participant in a day-long conference at Fordham University's law school entitled, "Islamic Law and Financial Symposium," on February 23, 2009. After he gave the standard rah-rah Shariah finance is a win-win, someone from the audience asked him about the lawsuit. His answer: "While I will not comment on pending litigation, what I can say is that we are absolutely certain that the court will dispense with it very expeditiously."

Maybe it is time for Mr. Baxter and the other government lawyers to enroll in Mr. Yerushalmi's newly published on line continuing legal education (CLE) course designed for financial institution compliance officers, SEC lawyers, Treasury officials, and investors, on the civil liability and criminal exposure risks associated with Shariah-compliant finance (available here.) Maybe then the Baxters of the world could offer their learned opinions rather than just the standard arrogant hot air of a government bureaucrat who insists the government can do no wrong."

Al Qaeda's Nuclear Inventory

The beginning of the end took place on Sept. 27, 1991, when President George H. W. Bush Announced that the United States would unilaterally withdraw all nuclear weapons from its forces around the world with the proviso that Soviet leader Mikhail Gorbachev would do likewise. Gorbachev readily agreed. The press and the people of both nations were pleased. The agreement represented a grand display of perestroika -- positive proof that the cold war was over and a new day of mutual trust (if not brotherhood) had dawned. The process of the withdrawal of the nukes was greatly facilitated by the enactment of the Nunn-Lugtar Soviet Threat Reduction Act on December 12, 1991. This act provided Russia with millions in funding to transport its nukes to various sites throughout the fourteen newly created republics of what was once the Soviet Union. This, too, seemed like a sensible measure that would make the world a safer place.

Yet the movement of the twenty-two thousand nuclear weapons occurred when everything in Russia was falling apart. With the closing of the communal plants and industries, more than 30 percent of the workforce became unemployed. Inflation soared over 2,000 percent, fueling crime and corruption. An average of eighty-four murders took place a day, many of which were contract killings. A hit could now be arranged with members of eight Mafia families within Moscow for less than $200. Millions of Russians now stood in lines for hours in order to redeem governement-issued coupons. There was one line for red beets and cabbages; another for eggs and bread; and yet another for vodka and cigarettes. Butcher shops sold blue chickens that had died of malnutrition and pies made from rancid beef and horse meat. The savvy customers soon learned not to purchase the pies that were surrounded by dead flies. In the wink of an eye, the second most powerful nation on earth had become transformed into a third world country.

Undfer the new capitalism, male life expectancy fell to fifty-eight years --- fifteen to seventeen years less than that of males in eastern Europe and the United States. By 1996 the suicide rate had doubled. Along with poverty, inflation, unemployment, and depression, Russians experienced a sharp drop in the birth rate. From 1991 to 2001, the population declined at a rate of 1.2 million a year.

Nowhere was the misery more apparent than within the military, which by 1996 had shrunk to a feeble force of 1.7 million soldiers. Because of chronic food shortages, many soldiers resorted to begging. More than ten Russian soldiers died each day from noncombat causes, including suicide and malnutrition. An estimated 110,000 loacked proper housing and became sheltered in hovels. No one in the military, not even a high-ranking general, was receiving a regular pay check. Russian army and navy officers began to sell almost every item at their disposal. In 1993 there were 6,430 reports of stolen weapons from army arsenals, ranging from assault rifles to tanks.

It is incredible to assume that the twenty-two thousand nuclear weapons were moved from strategic sites to arsenals throughout Russia without a single loss. When President George H. W. Bush announced his plans for a nuclear withdrawal, the then secretary of defense Dick Cheney said that the recovery of 90 percent of the nukes in Russia would represent "excellent performance." Such an "excellent performance" would mean that 220 weapons would have been lost, stolen, or otherwise unaccounted for. But what person in his right mind could expect such an outcome from the poorly housed, malnourished, disillusioned, and unpaid Russian troups of 1991? The temptation for gain would have been too great for an Orthodox saint to suppress when a kilo of chrominum-50 would sell for $25,000, cesium-137 for $1 million, and lithium for $10 million. Prospective buyers included agents from North Korea, Pakistan, Libya, and a well-financed group of Muslim terrorists called al Qaeda.

In the first three years after the collapse of the Soviet Union, the black market in nuclear weapons and materials began to boom. Germany reported more than seven hundred attempted nuclear sales. These illegal sales were luckily stopped by the police, but that was not true of every case of smuggling. Other incidents have been more alarming. In January 1992 an Egyptian newspaper reported that Iran bought three Soviet nuclear warheads from Kazakhstan for $150 million. This report was later confirmed by Russian intelligence. In November 1993 two nuclear warheads, sufficient to kill millions in New York and Los Angeles, were stolen by two employees from the Zlatoust-36 Instrument Building Plant, a weapons assembly facility, in Chelyabinsk. Fortunately, the weapons were later recovered in a nearby residential garage, and the two employees were placed under arrest. Later that same month, Russian navy Captian Alexei Tikhomirov broke into a nuclear storage facility at the Sevmorput shipyard near Murmansk and robbed three pieces of a reactor core containing 3.4 kilograms of highly enriched uranium. At the time of Tikhomirov's arrest, the chief Russian prosecutor noted that "potatoes were guarded better" that the nuclear materials at Murmansk.

The Chechen Mafia, the most powerful criminal organization in Russia, now became the most dominant force in the trafficking of nuclear supplies and materials from Russia to rogue nation and terrorist groups. In March 1993 the Chechens seciured an unknown quantity of highly enriched uranium from Kazakhstan. More than six kilograms were transported from Grozny, the capital of Chechnya, to Istanbul, Turkey. Six months later, Interpol officials collared four Turkish businessmen and four agents of Iran's secret service and confiscated 2.5 kilos of the uranium. The remaining kilos had slipped through the proverbial cracks. In September 1993 the Chechen rebels stunned the world by the display of SS-20 missiles during a military parade in Grozny. The missiles, stolen from some Soviet arsenal, possessed a range of 9,500 kilometers and the capability to launch a nuclear warhead.

At the same time, the Chechen rebels began using radioactive isotopes, which had become available at rock-bottom prices, to commit acts of murder. The first victim was Vladimir Kaplun, the owner of a meat packing plant in Moscow. The Chechens planted gamma ray-emitting pellets in Kaplun's office. The businessman was dead within a matter of weeks. At least half a dozen similar cases were reported in the next three weeks.

In November 1994 Dzokhar Dudayev, the leader of the Chechen rebels, petitioned the Uniter Nations to dispatch troops to protect the weapons of mass destruction within the Chechen arsenal. Dudayev's request was taken as an attempt at grandstanding. The UN officials, along with the international press, scoffed at the notion that a group of Muslim dissidents from the backwater Russian province of Chechnya could possess, let alone maintain, nuclear weapons. This forced the Chechens to make a vivid display that would prove to the world that they possessed nuclear capability. On November 23, 1995, Chechen commander Shamil Basayev directed a television crew to a radiological bomb that had been planted in Izmailovsky Park near Moscow. The bomb was made of cesium-137 and, if detonated, would have killed hundreds in a matter of minutes and contaminated thousands more. The incident represented the first case of a dirty nuke to be shown as a weapon of terror.

Shortly after this incident, Dudayev notified the US State Department that he possessed tactical nuclear suitcase bombs. The Chechen leader said that he was willing to sell these weapons to rogue states of terrorist agencies, such as al Qaeda, if the United States failed to recognize Chechnya's independence from Russia. Dudayev's claim was supported by officials from the National Intelligence Council, an unbrella organization for the US analytical community. The officials informed a congressional committee that weapon-grade and weapons-usable nuclear material, including SADMs (small atomic demolition munitions), had been stolen from Soviet stockpiles. "Of these thefts," the officials said, "we assess that undetected smuggling has occurred, although we do not know the extent or the magnitude.

In January 1996 the Center for Nonproliferation Studies at the Monterey Institute of Internation Studies received information from a "senior advisor to Boris Yeltsin" that an unspecified number of small nuclear bombs had been manufactured for the KGB and had never appeared on a list of the Soviet nuclear inventory.

In May 1997, during a closed door session with a US congressional delegation, former Russian Security Council secretary Alexander Lebed said that more than eighty-four SADMs had disappeared from Russian arsenals and could be in the hands of Muslim extremists. General Lebed said that he was able to confirm the production of 132 small nukes but could only account for 48. When asked the whereabouts of the missing nukes, Lebed replied: "I have no idea." He went on to say that he had no idea how many small nukes had been produced by the Soviet Union during the Cold War. Lebed also said that some of these small nukes, with explosive yield of one kiloton of TNT, had been refined so that they could be carried by one person in a case measuring sity by forty by twenty centimeters (twenty-four by sixteen by eight inches) and represented "ideal weapons for nuclear terror."

General Lebed repeated these charges in an interview with the CBS newsmagazine 60 minutes that was aired on September 7, 1997. In the interview, he added that the SADMs were designed to be used in sabotage operations behind enemy lines and lacked the electronic combination locks that had been built into other Soviet nuclear weapons. The following is a sample of the exchange between CBS correspondent Steve Kroft and General Lebed over the matter of the missing nukes:

Kroft: Are you confidant that all of the weapons aqre secure and acoounted for?

Lebed: Not at all. Not at all.

Kroft: How easy would it be to steal one?

Lebed: It's suitcase-sized.

Kroft: You could put it in a suitcase and carry it off?

Lebed: It is made in the size of a suitcase. It is a suitcase, actually. You could carry it. You could put it in another suitcase if you want to.

Kroft: But it's already a suitcase.

Lebed: Yes.

Kroft: I could walk down the streets of Moscow or Washington or New York, and people would think I'm carrying a suitaces?

Lebed: Yes, indeed.

Kroft: How easy would it be to detonate?

Lebed: It would take twnety, thirty minutes to prepare.

Kroft: But you don't need secret codes from the Kremlin or anything like that?

Lebed: No.

Kroft: You are saying there are a significant number that are missing and unaccounted for?

Lebed: Yes, there is. More than one hundred.

Kroft: Where are they?

Lebed: Somewhere in Georgia, somewhere in Ukraine, somewhere in the Baltic countries. Perhaps some are even outside those countries. One person is capable of triggering this nuclear weapon -- one person.

Kroft: So you are saying these weapons are no longer under the control of the Russian military?

Lebed: I'm saying that more than one hundred weapons are not under the control of the armed forces of Russia. I don't know their location. I don't know whether they have been destroyed or whether they are stored or whether they've been sold or stolen. I don't know.

"HONOLULU — Hawaii's state Senate overwhelmingly approved a bill Wednesday to celebrate "Islam Day" — over the objections of a few lawmakers who said they didn't want to honor a religion connected to Sept. 11, 2001. The Senate's two Republicans argued that a minority of Islamic extremists have killed many innocents in terrorist attacks.

"I recall radical Islamists around the world cheering the horrors of 9/11. That is the day all civilized people of all religions should remember," said Republican Sen. Fred Hemmings to the applause of more than 100 people gathered in the Senate to oppose a separate issue — same-sex civil unions. The resolution to proclaim Sept. 24, 2009, as Islam Day passed the Senate on a 22-3 vote. It had previously passed the House."

Can Marijuana Help Rescue California's Economy?

Could marijuana be the answer to the economic misery facing California? Democratic state assemblyman Tom Ammiano thinks so. Ammiano introduced legislation last month that would legalize pot and allow the state to regulate and tax its sale — a move that could mean billions of dollars for the cash-strapped state. Pot is, after all, California's biggest cash crop, responsible for $14 billion a year in sales, dwarfing the state's second largest agricultural commodity — milk and cream — which brings in $7.3 billion a year, according to the most recent USDA statistics. The state's tax collectors estimate the bill would bring in about $1.3 billion a year in much needed revenue, offsetting some of the billions of dollars in service cuts and spending reductions outlined in the recently approved state budget.

"The state of California is in a very, very precipitous economic plight. It's in the toilet," says Ammiano. "It looks very, very bleak, with layoffs and foreclosures, and schools closing or trying to operate four days a week. We have one of the highest rates of unemployment we've ever had. With any revenue ideas, people say you have to think outside the box, you have to be creative, and I feel that the issue of the decriminalization, regulation and taxation of marijuana fits that bill. It's not new, the idea has been around, and the political will may in fact be there to make something happen." (See pictures of stoner cinema.)

Ammiano may be right. A few days after he introduced the bill, U.S. Attorney General Eric Holder announced that states should be able to make their own rules for medical marijuana and that federal raids on pot dispensaries in California would cease. The move signaled a softening of the hard-line approach to medicinal pot use previous Administrations have taken. The nomination of Gil Kerlikowske as the head of the Office of National Drug Control Policy may also signal a softer federal line on marijuana. If he is confirmed as the so-called drug czar, Kerlikowske will take with him experience as police chief of Seattle, where he made it clear that going after people for possessing marijuana was not a priority for his force. In 1996 California became one of the first states in the nation to legalize medical marijuana. Currently, $200 million in medical-marijuana sales are subject to sales tax. If passed, the Marijuana Control, Regulation and Education Act (AB 390) would give California control of pot in a manner similar to that of alcohol while prohibiting its purchase by citizens under age 21. (The bill has been referred to the California state assembly's public-safety and health committees; Ammiano says it could take up to a year before it comes to a vote for passage.) State revenues would be derived from a $50-per-oz. levy on retail sales of marijuana and sales taxes. By adopting the law, California could become a model for other states. As Ammiano put it, "How California goes, the country goes."

Despite the need for the projected revenue, opponents say legalizing pot would only add to social woes. "The last thing we need is yet another mind-altering substance to be legalized," says John Lovell, lobbyist for the California Peace Officers' Association. "We have enough problems with alcohol and abuse of pharmaceutical products. Do we really need to add yet another mind-altering substance to the array?" Lovell says the easy availability of the drug would lead to a surge in its use, much as happened when alcohol was allowed to be sold in venues other than liquor stores in some states. Joel W. Hay, professor of pharmaceutical economics at USC, also foresees harm if the bill passes. "Marijuana is a drug that clouds people's judgment. It affects their ability to concentrate and react, and it certainly has impacts on third parties," says Hay, who has written on the societal costs of drug abuse. "It's one more drug that will add to the toll on society. All we have to do is look at the two legalized drugs, tobacco and alcohol, and look at the carnage that they've caused. [Marijuana] is a dangerous drug, and it causes bad outcomes for both the people who use it and for the people who are in their way at work or other activities." He adds, "There are probably some responsible people who can handle marijuana, but there are lots of people who can't, and it has an enormous negative impact on them, their family and loved ones." In response, retired Orange County Superior Court Judge James Gray, a longtime proponent of legalization, estimates that legalizing pot and thus ceasing to arrest, prosecute and imprison nonviolent offenders could save the state $1 billion a year. "We couldn't make this drug any more available if we tried," he says. "Not only do we have those problems, along with glamorizing it by making it illegal, but we also have the crime and corruption that go along with it." He adds, "Unfortunately, every society in the history of mankind has had some form of mind-altering, sometimes addictive substances to use, to misuse, abuse or get addicted to. Get used to it. They're here to stay. So let's try to reduce those harms, and right now we couldn't do it worse if we tried."

UN Sets Dangerous Precedent with "Defamation of Religions" Resolutions

February 13,2009

"The basic human right to freedom of expression is increasingly under threat as countries introduce and enforce laws that have been wrongfully legitimized by numerous United Nations resolutions on "defamation of religions." In a statement sent to the UN Human Rights Council today, Freedom House and the Becket Fund for Religious Liberty strongly urged members of the council to reject any further resolutions when they meet in Geneva for the upcoming 10th Session March 2-27, and to further reject any attempts to create international instruments or mechanisms that would prohibit "defamation of religions."

The statement explains how such resolutions directly violate international law and can encourage countries to increase the repression of religious minorities, political dissidents and human rights advocates. It points to a 2008 joint report by two UN special rapporteurs that soundly rejects the premise that the rights of religious believers are violated by merely hearing statements critical of their faith: "Defamation of religions may offend people and hurt their religious feelings but it does not necessarily or at least directly result in a violation of their rights."

Several recent high-profile cases have highlighted the growing conflict between freedom of expression and so-called religious "defamation." This month, Indian authorities arrested the editor and the publisher of the Statesman, after Muslims protested the newspaper reprinting an article from the United Kingdom's Independent titled, "Why should I respect these oppressive religions?" The article decried the erosion of the right to criticize religions, including Judaism, Christianity and Islam.

In another case, Random House backed out of a deal last year to publish "The Jewel of Medina," a fictional novel about one of the wives of Muhammad citing concerns that "the publication of this book might be offensive to some in the Muslim community" and that it could "incite acts of violence." In September, Gibson Books announced it would publish the book in the United Kingdom, but the publisher's home and office were fire bombed three weeks later. The book was eventually published in the United States by Beaufort Books.

"Although we are sympathetic to the stated goals of the resolutions of combating intolerance, racism, and religious hatred, we believe that such resolutions do not serve to achieve these goals but rather limit the ability of individuals to raise questions, concerns, and even criticisms at a time when people of all faiths need to engage in more, not less, dialogue," said Freedom House and the Becket Fund.

The full text of the statement follows:

Concern over UN Resolutions on "Combating Defamation of Religions"

1. On the occasion of the 10th Session of the Human Rights Council, Freedom House and the Becket Fund for Religious Liberty express concern over the resolutions on "combating defamation of religions" adopted by the Human Rights Council and the General Assembly since 1999[1]. We urge members of the Council to reject such resolutions in the future and further urge them to reject attempts to create international instruments or mechanisms that would prohibit "defamation of religions."

2. Although we are sympathetic to the stated goals of the resolutions of combating intolerance, racism, and religious hatred, we believe that such resolutions do not serve to achieve these goals but rather limit the ability of individuals to raise questions, concerns, and even criticisms at a time when people of all faiths need to engage in more, not less, dialogue. Moreover, we believe these resolutions directly violate existing international law regarding the fundamental freedoms of expression, thought, conscience and religion.

3. In particular, the resolutions should be rejected on the grounds that 1) the term "defamation of religions" is overly vague, open to abuse, and inconsistent with traditional defamation legislation; 2) the resolutions attempt to provide rights to a belief or idea rather than an individual or group of individuals in contradiction of existing international law; 3) the concept of "defamation of religions" restricts freedom of expression beyond accepted limitations defined in the International Covenant on Civil and Political Rights; 4) the concept of "defamation of religions" violates the universal right to freedom of thought, conscience, and religion; and 5) the concept of "defamation of religions" falsely equates religious belief with race.

Problems with the definition of "defamation of religions"

4. The term "defamation of religions" has not been clearly defined and is therefore subject to misuse and abuse. The legal term "defamation" is typically defined as the spreading of mistruths intended to harm an individual's reputation and livelihood. However, by attempting to apply such a definition to ideas or religious beliefs, which by their very nature conflict with opposing ideas or religious beliefs, it is impossible to evaluate whether ideas or religious beliefs represent truths or mistruths. As was noted in the Becket Fund's "Issues Brief for the OHCHR" of June 2008, "religions make conflicting truth claims and indeed the diversity of truth claims is something that religious freedom as a concept is designed to protect."[2] Thus, the concept of "defamation of religions" can be defined as the expression of ideas or beliefs that simply conflict with or offend the ideas of others.

5. Further, because the resolutions call on States to enact necessary legislation to prohibit the advocacy of national, racial or religious hatred, it would be left up to governments to define whether ideas expressed are offensive or, in the language of the resolution, "defame" a religious belief. Governments would thus be forced to pick and choose among competing faith claims.

6. In countries with domestic laws that use equally vague or poorly defined language to restrict individuals from "defaming" or "defiling" religions, the government often "picks" the majority religion over minority religions. These laws are frequently applied to punish individuals from expressing questions, concerns and criticisms of the majority religion.[3] The application of similar legal mechanisms at the international level would not only legitimate such existing problematic domestic legislation, but would result in a greater proliferation of such legislation to other countries.
Problems with providing rights to a belief or idea rather than individuals

7. International law regarding freedom of religion and expression, as defined in the Universal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR), has been established to protect individuals and in some case groups of individuals from the violation of their rights. Thus, Articles 18 of both the UDHR and the ICCPR states, "Everyone shall have the right to freedom of thought, conscience and religion." (Emphasis added.) Articles 19 of both documents define the right of "everyone" to freedom of opinion and expression free from interference. (Emphasis added.)

8. These documents lay out the right of individuals to hold and express beliefs and ideas and are designed to protect them from discrimination based on their beliefs. However, these documents are not intended to protect the beliefs themselves from criticism or even attack.

9. As the UN Special Rapporteur on freedom of religion or belief together with the Special Rapporteur on contemporary forms of racism, xenophobia and related intolerance wrote in a joint report presented at a special seminar on this topic held by the OHCHR in October, 2008.

"Defamation of religions may offend people and hurt their religious feelings but it does not necessarily or at least directly result in a violation of their rights, including their right to freedom of religion. Freedom of religion primarily confers a right to act in accordance with one's religion but does not bestow a right for believers to have their religion itself protected from all adverse comment."[4]

Violations of freedom of expression

10. Article 19 of the ICCPR states that, "Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice."

11. The right to free expression and the right to impart information and ideas of all kinds is not intended to be absolute, but rather is restricted by Article 20 of the ICCPR, which calls on signatories to create law prohibiting the "advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence." While this language of the ICCPR is itself overly vague and could be better defined, it is our belief that the term "defamation"-because it can be interpreted so broadly-does not necessarily cross the line of inciting discrimination, hostility or violence.

12. In other words, because the definition of "defamation" can be interpreted to include ideas or beliefs that simply conflict with or offend the ideas of others, the term oversteps the restrictions on free expression laid out in international law and places unnecessary and dangerous restrictions on the ability of individuals to freely express conflicting beliefs or to address disagreements through peaceful public debate. Such restrictions will have the opposite effect of increasing religious intolerance and hatred than what the resolutions on "combating defamation of religions" are purportedly designed to combat.

Violations of freedom of thought, conscience, and religion

13. Article 18 of the ICCPR protects not only the freedom to have or adopt a particular religion or belief, but also protects an individual's freedom to manifest his religion or belief.[5] As stated in General Comment No. 22, the freedom to manifest religion includes the sharing of beliefs, thoughts, and ideas.[6] It is this right to manifest belief that allows for inter-religious dialogue efforts to occur within the walls of the UN and around the world. Initiatives like the UN's Alliance of Civilizations[7] and the Saudi Culture of Peace initiative rely upon the free exchange of ideas and beliefs. Yet such initiatives are in direct contradiction to the concept of "defamation of religions."

Conflation of Race and Religion

14. The conflation of race and religion diminishes the uniqueness of both race and religion. Unlike immutable race, religion involves the freedom to follow one's conscience, and implies dialogue and debate with others about the truth claims involved. Treating racial and religious discrimination as the same thing thus confuses racist hate speech with debate about (sometimes controversial) competing truth claims. Whereas one can easily identify and narrowly define racist hate speech, it is not nearly so simple to define what falls into the category of "defamation of religion," which as currently characterized can include any controversial truth claim about someone's religion. Race-based speech restrictions have never been used to cut off discussion about racial identity, whereas the "defamation of religion" measures by definition prohibit controversial discussion of religious belief.

"Biofuels may have hit an unexpected roadblock with a pronouncement by Sheik Mohamed al-Najimi of the Saudi Islamic Jurisprudence Academy that the fuel may be prohibited by Islam. According to al-Najimi, the prophet Muhammad prohibited the buying, selling, transporting, drinking, and manufacturing of alcohol - including the ethyl alcohol present in ethanol.

If other religious leaders take al-Najimi’s opinion seriously, biofuel could be banned in Muslim countries that currently disallow alcohol. That means Saudi Arabia, Qatar, Libya, and Sudan could potentially become biofuel-free zones.

While al-Najimi says that his recommendation should not be considered a fatwa (a legal pronouncement in Islam), he does believe that restriction of biofuels should go beyond Muslim countries to include Muslims around the world.

Bank giant UBS admits conspiring to hide U.S. taxpayers' assets

"WASHINGTON – Banking giant UBS has agreed to pay $780 million and turn over once-secret Swiss banking records to settle allegations it conspired to defraud the U.S. government of taxes owed by big clients....

UBS will pay $780 million in fines, penalties, interest and restitution for conspiring to create sham accounts to hide the assets of U.S. clients from the U.S. government.

According to U.S. officials, when an acquisition in 2000 of a U.S. company brought UBS a host of new, American clients, the bank set about to evade new reporting requirements for those clients. To do so, UBS executives helped U.S. taxpayers open new accounts in the names of sham entities.

Prosecutors contend that UBS executives used encrypted software and other counter-surveillance techniques to prevent anyone from detecting that they were actively marketing such Swiss bank secrecy — and tax evasion — to American taxpayers.

The clients, in turn, filed false tax returns that omitted the income they earned in their Swiss accounts, according to the court papers.

Federal officials said they had pulled aside a veil of secrecy that hid a corrupt international banking practice.

"This was not a mere compliance oversight, but rather a knowing crime motivated by greed and disrespect for the law," said Alexander Acosta, U.S. attorney for southern Florida.

Internal Revenue Service Commissioner Doug Shulman warned U.S. taxpayers hiding money overseas that it was time to come clean with Uncle Sam.

"People who have hidden unreported income offshore need to get right with their government. They should come forward and take advantage of our voluntary disclosure process," Shulman said.

Sen. Carl Levin, D-Mich., has estimated that abusive tax shelters and hidden offshore accounts cost the U.S. government nearly $100 billion a year in lost tax revenue.

Prosecutors are still hunting for UBS executive Raoul Weil, who was indicted in November 2008 on charges he conspired to defraud the government for overseeing the bank's cross-border business.

In June 2008 former UBS banker Bradley Birkenfeld pleaded guilty to a similar charge.

If UBS fails to turn over the clients' information, or stops cooperating with authorities, federal prosecutors could refile charges against the bank.

Under the deal, UBS also will completely stop engaging in the type of cross-border banking business that got them into trouble."

GAFFNEY: Treasury submits to Shariah

"The U.S. Treasury Department is submitting to Shariah - the seditious religio-political-legal code authoritative Islam seeks to impose worldwide under a global theocracy.

As reported in this space last week, Deputy Secretary of the Treasury Robert Kimmitt set the stage with his recent visit to Saudi Arabia and other oil-rich Persian Gulf states. His stated purpose was to promote the recycling of petrodollars in the form of foreign investment here.

Evidently, the price demanded by his hosts is that the U.S. government get with the Islamist financial program. While in Riyadh, Mr. Kimmitt announced: "The U.S. government is currently studying the salient features of Islamic banking to ascertain how far it could be useful in fighting the ongoing world economic crisis."

"Islamic banking" is a euphemism for a practice better known as "Shariah-Compliant Finance (SFC)." And it turns out that this week the Treasury will be taking officials from various federal agencies literally to school on SFC.

The department is hosting a half-day course entitled "Islamic Finance 101" on Thursday at its headquarters building. Treasury's self-described "seminar for the policy community" is co-sponsored with the leading academic promoters of Shariah and SCF in the United States: Harvard University Law School's Project on Islamic Finance. At the very least, the U.S. government evidently hopes to emulate Harvard's success in securing immense amounts of Wahhabi money in exchange for conforming to the Islamists' agenda. Like Harvard, Treasury seems utterly disinterested in what Shariah actually is, and portends.

Unfortunately, such submission - the literal meaning of "Islam" - is not likely to remain confined long to the Treasury or its sister agencies. Thanks to the extraordinary authority conferred on Treasury since September, backed by the $700 billion Troubled Asset Relief Program (TARP), the department is now in a position to impose its embrace of Shariah on the U.S. financial sector. The nationalization of Fannie Mae and Freddie Mac, Treasury's purchase of - at last count - 17 banks and the ability to provide, or withhold, funds from its new slush-fund can translate into unprecedented coercive power....

... After all, the object of Shariah is the supplanting of our government and Constitution, through violent means if possible and, until then, through stealthy ones. Islamists, having secured footholds via their parallel societies, inevitably use those to extend their influence over Muslims who have no more interest in living under authoritative Islam's Shariah than the rest of us do. Inexorably, it becomes the turn of non-Muslims to accommodate themselves to ever more intrusive demands from the Islamists...

"WASHINGTON (Reuters) – U.S. steel companies urged congressional leaders on Tuesday to maintain a strong "Buy American" provision as part of a final economic stimulus bill sent to President Barack Obama.

The plea came as major U.S. exporters like Caterpillar and Microsoft pushed for either eliminating or substantially weakening the measure, which they say would raise the cost of public works projects funded by the stimulus bill and send a protectionist signal to the rest of the world.

Canada, the European Union and other U.S. trading partners are also closely watching congressional negotiations on the Buy American plan, which would give preference to domestic steel companies and possibly other U.S. manufacturers.

"Procurement of competitively priced steel products and specialty metals from competitive domestic sources will not cost the U.S. taxpayer more," the American Iron and Steel Institute said in a letter to congressional leaders.

"It will in fact generate payroll and income tax returns to the U.S. government as a result of stimulating American jobs," the steel companies said, adding the United States has various Buy American provisions on the books for years without causing a trade war...."

"The Amsterdam appeals court has ordered the prosecution of member of parliament Geert Wilders for inciting hatred and discrimination, based on comments by him in various media on Muslims and their beliefs," the court said in a statement.

"The court also considers appropriate criminal prosecution for insulting Muslim worshippers because of comparisons between Islam and Nazism made by Wilders," the statement said.

"Fitna", a Koranic term sometimes translated as "strife", intersperses shots of the Sept. 11, 2001, attacks and other bombings with quotations from the Koran. "I love Thomas Jefferson’s New Year’s Day greeting to the Danbury Baptists in part because it drives the Religious Right into such paroxysms of paranoia, ignorance and intemperance.

As I’m sure most of you know, President Jefferson sent a friendly missive to his Baptist admirers in Connecticut on Jan. 1, 1802. He thanked them for their support of him and of religious liberty. He also celebrated the First Amendment’s religious liberty provisions and expressed sympathy for the Baptists’ plight in a state where religious minorities still faced government hostility.

Jefferson famously observed: “Believing with you that religion is a matter which lies solely between Man & his God, that he owes account to none other for his faith or his worship, that the legitimate powers of government reach actions only, & not opinions, I contemplate with sovereign reverence that act of the whole American people which declared that their legislature should ‘make no law respecting an establishment of religion, or prohibiting the free exercise thereof,’ thus building a wall of separation between Church & State. Adhering to this expression of the supreme will of the nation in behalf of the rights of conscience, I shall see with sincere satisfaction the progress of those sentiments which tend to restore to man all his natural rights, convinced he has no natural right in opposition to his social duties.”

Jefferson’s “wall of separation” metaphor has proved handy over the years as a convenient means of describing the relationship between religion and government in the United States. Religious and political leaders, judges and citizen activists have often cited that protective constitutional barrier as they battle for true religious liberty, and many of us still do.

To the theocracy-minded, however, Jefferson’s wall is a never-ending source of sorrow. It stands between them and their goal of a government that imposes their religion on everyone by force of law.

Recently, Townhall pundit Christopher Merola launched two incendiary columns at the wall and those who support it. His essays are so pathetically mired in inaccuracies, smears and conspiracy theories, they would make a John Birch Society acolyte blush. He rails against Supreme Court’s 1947 Everson opinion that celebrated Jefferson’s wall and he singles out Justice Hugo Black and others who support it for vitriolic abuse.

Merola says Everson was “horribly decided” and charges that “FDR appointee Hugo Black, a member of the Ku Klux Klan, reinterpreted the meaning of the First Amendment of the Constitution.” He says Black took Jefferson’s wall metaphor “completely out of context” and “limited the religious liberty of all Americans.”

Merola claims that thanks to the Supreme Court, little girls are kept from praying in public school and he hints darkly that anti-God conspiracies kept references to religion out of the new Capitol Visitors Center.

Like all good Red-baiters, Merola traces the problem to communists and the ACLU.

“We must not,” he says, “ allow ourselves to buy into the delusion of Roger Baldwin, the founder of the American Civil Liberties Union (ACLU) and a member of the Communist Party of the USA, who desired the removal of all references to God from the public square.”

Merola concludes, “Consider what has occurred in the last sixty years or so. The freedom of religion in America has been limited and even demonized in some cases, due to a lie that began with a member of the Communist Party of the USA, who influenced an FDR appointee to the Supreme Court, who was himself a member of the Ku Klux Klan. It’s totally insane! “

What’s insane, of course, is Merola’s take on American history and the protections of our Constitution.

Justice Black was indeed a member of the Ku Klux Klan in his Alabama youth. But Black’s record on the high court shows no hint of racial and religious bigotry. On the contrary, his decisions upheld the civil rights and civil liberties of all Americans. (In the Everson case itself, Black called for high wall of separation, but at the same time he ruled in favor of bus transportation aid to Catholic schools. That’s hardly the work of an anti-Catholic bigot!)

As for the actions of Franklin Roosevelt and the ACLU, I’ll let their records speak for themselves. Right-wingers have made Roosevelt a villain for years, but most Americans still regard him as a great leader who brought us out of the Great Depression and saved the world from fascism in the Second World War.

Say what you will about the ACLU – I don’t agree with them all the time myself — but Americans’ rights would be less firmly established if that organization were never founded.

Put simply, there is no KKK-Communist-ACLU-FDR plot to end religious liberty in America. It’s absurd to think that the far-right KKK has ever worked in tandem with communists and Franklin Roosevelt to restrict civil liberties. Hey, Merola, you left the Masons, the Illuminati, the Bilderbergers, the UN and the Mafia out of your little conspiracy theory. Get out your tin foil hat, buddy, and add some new players to your imaginative and imaginary drama!

Merola, by the way, is described as “the Political Director for Political Media, Inc, a political advertising and public relations firm in Washington, DC.” Isn’t it sad that politics and public relations in the nation’s capital sometimes sink to this level?

Here’s the real scoop. From Jefferson on, thoughtful Americans have understood that true religious liberty means that government stays out of religious matters. That’s not a plot; it’s common sense – and it’s the mandate of our Constitution. The American people have, indeed, built a wall of separation between church and state, and it will take more than the ravings of Religious Right zealots such as Merola to tear it down.

Happy New Year, everybody! 2009 looks brighter on the civil liberties front than 2008, but we’ll still need your help in stalwart defending church-state separation. Stay with us!!"

I think Freethinkers should challenge traditional religious holiday celebrations. Such as "Christmas" and "Easter" for example. "The U.S. Treasury Department is submitting to Shariah - the seditious religio-political-legal code authoritative Islam seeks to impose worldwide under a global theocracy.

As reported in this space last week, Deputy Secretary of the Treasury Robert Kimmitt set the stage with his recent visit to Saudi Arabia and other oil-rich Persian Gulf states. His stated purpose was to promote the recycling of petrodollars in the form of foreign investment here.

Evidently, the price demanded by his hosts is that the U.S. government get with the Islamist financial program. While in Riyadh, Mr. Kimmitt announced: "The U.S. government is currently studying the salient features of Islamic banking to ascertain how far it could be useful in fighting the ongoing world economic crisis."

"Islamic banking" is a euphemism for a practice better known as "Shariah-Compliant Finance (SFC)." And it turns out that this week the Treasury will be taking officials from various federal agencies literally to school on SFC.

The department is hosting a half-day course entitled "Islamic Finance 101" on Thursday at its headquarters building. Treasury's self-described "seminar for the policy community" is co-sponsored with the leading academic promoters of Shariah and SCF in the United States: Harvard University Law School's Project on Islamic Finance. At the very least, the U.S. government evidently hopes to emulate Harvard's success in securing immense amounts of Wahhabi money in exchange for conforming to the Islamists' agenda. Like Harvard, Treasury seems utterly disinterested in what Shariah actually is, and portends.

Unfortunately, such submission - the literal meaning of "Islam" - is not likely to remain confined long to the Treasury or its sister agencies. Thanks to the extraordinary authority conferred on Treasury since September, backed by the $700 billion Troubled Asset Relief Program (TARP), the department is now in a position to impose its embrace of Shariah on the U.S. financial sector. The nationalization of Fannie Mae and Freddie Mac, Treasury's purchase of - at last count - 17 banks and the ability to provide, or withhold, funds from its new slush-fund can translate into unprecedented coercive power....

... After all, the object of Shariah is the supplanting of our government and Constitution, through violent means if possible and, until then, through stealthy ones. Islamists, having secured footholds via their parallel societies, inevitably use those to extend their influence over Muslims who have no more interest in living under authoritative Islam's Shariah than the rest of us do. Inexorably, it becomes the turn of non-Muslims to accommodate themselves to ever more intrusive demands from the Islamists...

The Mother of All Bailouts has many fathers. As panicked politicians prepare to fork over $1 trillion in taxpayer funding to rescue the financial industry, they've fingered regulation, deregulation, Fannie Mae and Freddie Mac, the Community Reinvestment Act, Jimmy Carter, Bill Clinton, both Bushes, greedy banks, greedy borrowers, greedy short-sellers and minority home ownership mau-mauers (can't call 'em greedy, that would be racist) for blame.

But there's one giant paternal elephant in the room that has slipped notice: how illegal immigration, crime-enabling banks and open-borders Bush policies fueled the mortgage crisis.

It's no coincidence that most of the areas hardest hit by the foreclosure wave -- Loudoun County, Va., California's Inland Empire, Stockton and San Joaquin Valley, and Las Vegas and Phoenix, for starters -- also happen to be some of the nation's largest illegal alien sanctuaries. Half of the mortgages to Hispanics are subprime (the accursed species of loan to borrowers with the shadiest credit histories). A quarter of all those subprime loans are in default and foreclosure.

Regional reports across the country have decried the subprime meltdown's impact on illegal immigrant "victims." A July report showed that in seven of the 10 metro areas with the highest foreclosure rates, Hispanics represented at least one-third of the population; in two of those areas -- Merced and Salinas-Monterey, Calif. -- Hispanics comprised half the population. The amnesty-promoting National Council of La Raza and its Development Fund have received millions in federal funds to "counsel" their constituents on obtaining mortgages with little to no money down; the group almost succeeded in attaching a $10-million earmark for itself in one of the housing bills past this spring.

For the last five years, I've reported on the rapidly expanding illegal alien home loan racket. The top banks clamoring for their handouts as their profits plummet, led by Wachovia and Bank of America, launched aggressive campaigns to woo illegal alien homebuyers. The quasi-governmental Wisconsin Housing and Economic Development Authority jumped in to guarantee home loans to illegal immigrants. The Washington Post noted, almost as an afterthought in a 2005 report: "Hispanics, the nation's fastest-growing major ethnic or racial group, have been courted aggressively by real estate agents, mortgage brokers and programs for first-time buyers that offer help with closing costs. Ads proclaim: "Sin verificacion de ingresos! Sin verificacion de documento!" -- which loosely translates as, 'Income tax forms are not required, nor are immigration papers.'"

In addition, fraudsters have engaged in massive house-flipping rings using illegal aliens as straw buyers. Among many examples cited by the FBI: a conspiracy in Las Vegas involving a former Nevada First Residential Mortgage Company branch manager who directed loan officers and processors in the origination of 233 fraudulent Federal Housing Authority loans valued at over $25 million. The defrauders manufactured and submitted false employment and income documentation for borrowers; most were illegal immigrants from Mexico. To date, the FBI reported, "Fifty-eight loans with a total value of $6.2 million have gone into default, with a loss to the Housing and Urban Development Department of over $1.9 million."

It's the tip of the iceberg. Thanks to lax Bush administration-approved policies allowing illegal aliens to use "matricula consular cards" and taxpayer identification numbers to open bank accounts, more forms of mortgage fraud have burgeoned. Moneylenders still have no access to a verification system to check Social Security numbers before approving loans.

In an interview about rampant illegal alien home loan fraud, a spokeswoman for the U.S. General Accounting Office told me five years ago: "[C]onsidering the size of Los Angeles, New York, Chicago, Houston and other large cities throughout the United States known to be inundated with illegal aliens, I don't think the federal government is willing to expose this problem for financial reasons as well as for fear of political repercussions."

The chickens are coming home to roost. And law-abiding, responsible taxpayers are going to pay for it.

It is time for inexpensive, abundant energy based on advanced concepts in physics and electromagnetic technology to be supported with at least the same level of funding that solar and wind are now receiving.

Solar and Wind are great- but with one to two dirty coal-fired power plants being put on-line in China and India each week, it is too little, too late.

In this article, we read that Islamists have apparently finally worn down the Indians after 1200 years of siege. It appears that India itself will come under Muslim rule, thanks to the efforts of the Saudis.

"Canada’s Maclean’s magazine (involved in another controversial human rights case that I wrote about here and here) has published an extensive article detailing the “remarkably successful” campaign to make “defamation of religions” a violation of international law. (H/t: Volokh Conspiracy)

Led by the Organization of the Islamic Conference (OIC), a Saudi-funded international body made up of 56 Islamic states from around the globe, the push seeks to empower all governments to punish citizens who “defame” any religion — particularly Islam. What’s more:

Critics say it is an attempt to globalize laws against blasphemy that exist in some Muslim countries — and that the movement has already succeeded in suppressing open discussion in international forums of issues such as female genital mutilation, honour killings and gay rights.

The article also describes the tactics used to “create” this new international norm, which center around Islamic nations bringing resolutions condemning the “defamation of religions” before the UN Human Rights Council. These resolutions have been passed by landslide votes every single year for nearly 10 years.

It all sounds very well-meaning, of course. But as Maclean’s notes, the UN already has established laws protecting individuals from religious discrimination. This is a much broader effort.

This new definition of “defamation of religion” is radically different from what “defamation” has traditionally meant. While defamation laws used to protect individuals who were “materially harmed” by false statements, “defamation of religion” is

"…rather about protecting a religion, or some interpretation of it, or the feelings of the followers. While a traditional defence in a defamation lawsuit is that the accused was merely telling the truth, religions by definition present competing claims on the truth, and one person’s religious truth is easily another’s apostasy. “Truth” is no defence in such cases. The subjective perception of insult is what matters…"

As the article goes on to note, laws against “defamation of religions” seek to protect from “damages” not individuals who hold certain beliefs or ideas, but the ideas themselves. There could hardly be a notion more starkly antithetical to the foundations of freedom of speech and liberal democratic societies....."

Fox Business Channel has an “after-the-market-closes” show, called Happy Hour, which appears to exist in a surreal space of unreality: bar setting, complete with a bartender and business men with their brewskis in the background, host Rebecca Gomez looking like she’s ready to hook up and whose only research before interviewing Naomi Klein ( http://en.wikipedia.org/wiki/Naomi_Klein ) appears to be skimming the reviews of The Shock Doctrine ( http://www.naomiklein.org/shock-doctrine ) on Amazon, and to top it off, guest host Eric Bolling admits to not only being an oil trader, but never looking at the book! That’s respect, I’ll tell you, for the collective intelligence of their viewers as well as Naomi.

Still, with all the obstacles FBC places in the way of having an intelligent discussion, Klein manages to get in some great points that leave the embarrassingly ill-informed Faux hosts with little to do but sputter inanities like “Naomi, do you like capitalism?”

McDonald's franchisee will pay $1 million in Nevada illegal immigration case

"NEW YORK (AP) _ A McDonald's Corp. franchisee will pay a $1 million fine after pleading guilty in Las Vegas federal court to felony immigration offenses for giving false Social Security numbers to illegal aliens.

The charges follow an investigation by Immigration and Customs Enforcement officers, who have said management of Mack Associates Inc. knowingly hired illegal alien workers in Reno, Nev.-area McDonald's restaurants, supplying them with false identification.

The Justice Department released details of the plea agreement late Wednesday.

In U.S. District Court in Las Vegas, attorneys for Mack Associates filed guilty pleas to one count of conspiracy to encourage and induce an alien's unlawful residence in the U.S. and one count of aiding and abetting an alien to remain in the U.S., which are felony offenses.

According to the plea agreement, Mack Associates management hired people known to reside in the U.S. illegally, and gave them names and Social Security numbers belonging to other individuals.

In addition to the fine, the government and Mack Associates agreed that the company be placed on probation during the period the fine is outstanding.

Joe Gillespie, director of operations for Mack Associates, and the franchisee's former vice president, Jimmy Moore, pleaded guilty to aiding and abetting an alien to remain in the U.S. Both men face a maximum penalty of no more than five years in prison and a $250,000 fine.

In September, agents encountered 58 people working illegally at 11 McDonald's restaurants owned by Mack Associates near Reno, Nev., and were arrested. About 30 of these workers have been returned to their native countries. The remaining workers were provided with documentation to stay in the U.S., pending an outcome of the criminal investigation.

Representatives for Mack Associates and McDonald's were not immediately available to comment."

Hot future shock: Heat wave temperatures to soar

WASHINGTON - During the European heat wave of 2003 that killed tens of thousands, the temperature in parts of France hit 104 degrees. Nearly 15,000 people died in that country alone. During the Chicago heat wave of 1995, the mercury spiked at 106 and about 600 people died.

In a few decades, people will look back at those heat waves "and we will laugh," said Andreas Sterl, author of a new study. "We will find (those temperatures) lovely and cool."

Sterl's computer model shows that by the end of the century, high temperatures for once-in-a-generation heat waves will rise twice as fast as everyday average temperatures. Chicago, for example, would reach 115 degrees in such an event by 2100. Paris heat waves could near 109 with Lyon coming closer to 114.

Sterl, who is with the Royal Netherlands Meteorological Institute, projects temperatures for rare heat waves around the world in a study soon to be published in the journal Geophysical Research Letters.

His numbers are blistering because of the drying-out effect of a warming world. Most global warming research focuses on average daily temperatures instead of these extremes, which cause greater damage.

His study projects a peak of 117 for Los Angeles and 110 for Atlanta by 2100; that's 5 degrees higher than the current records for those cities. Kansas City faces the prospect of a 116-degree heat wave, with its current all-time high at 109, according to the National Climactic Data Center.

A few cities, such as Phoenix, which once hit 122 degrees and is projected to have heat waves of 120, have already reached these extreme temperatures once or twice. But they would be hitting those numbers a little more often as the world heats up over time. For New York, it would only be a slight jump from the all-time record of 104 at John F. Kennedy Airport to the projected 106.

It could be worse. Delhi, India is expected to hit 120 degrees; Belem, Brazil, 121, and Baghdad, 122.

Those figures make sense, Ken Kunkel, a top Midwestern climate scientist and interim director of the Illinois Water Survey.

These are temperatures that are dangerous, said University of Wisconsin environmental health professor Dr. Jonathan Patz.

"Extreme temperature puts a huge demand on the body, especially anyone with heart problems," Patz said. "The elderly are the most vulnerable because they don't sense temperature as well."

And it's not just at the end of the century. By 2050, heat waves will be 3 to 5 degrees hotter than now "and probably be longer-lasting," Sterl said.

By mid-century, southern France's extreme heat waves should be around 111 degrees and then near 118 by the end of the century, Sterl's climate models predict. In the 1990s, that region's extreme heat wave peaked at 104 degrees; in the 1950s, the worst heat wave peaked around 91 degrees, according to Sterl."

UK bans corporate product placement on TV

The U.K. media minister has attacked product placement in TV shows and said he will not allow the practice on British broadcasters even though it has been approved by the European Union.
The news is likely to infuriate TV companies, including beleaguered terrestrial giant ITV, which are all trying to find additional revenue streams as new media continues to make inroads into traditional advertising.

Andy Burnham, secretary of state at the Dept. of Culture, Media and Sport since January, dropped his bombshell Wednesday in his first big policy speech on broadcasting.

He said product placement would undermine the status that British TV enjoys internationally and “contaminate” programs.

He added, “There is a risk that, at the very moment when television needs to do all it can to show it can be trusted, that we elide the distinction between programs and adverts,” referring to the phone-in quiz scandals that rocked all British terrestrial webs last year.

“As a viewer, I don’t want to feel the script has been written by the commercial marketing director,” he added. “British programming has an integrity that is revered around the world, and I don’t think we should put that hard-won reputation up for sale.”

Last week, ITV topper Rupert Howell, in a speech about the new economics of TV, eagerly anticipated a time when U.K. television would be allowed to follow the U.S. example and use product placement.

Howell said it was vital to find new revenue streams soon and that product placement would be an important source of coin.

He said: “If we do it badly, people will switch off or switch over. We have to do it well. It will not be big, but it will be valuable.”

Why Is Bush Helping Saudi Arabia Build Nukes?

Here's a quick geopolitical quiz: What country is three times the size of Texas and has more than 300 days of blazing sun a year? What country has the world's largest oil reserves resting below miles upon miles of sand? And what country is being given nuclear power, not solar, by President George W. Bush, even when the mere assumption of nuclear possession in its region has been known to provoke pre-emptive air strikes, even wars?

If you answered Saudi Arabia to all of these questions, you're right.

Last month, while the American people were becoming the personal ATMs of the Organization of the Petroleum Exporting Countries, Secretary of State Condoleezza Rice was in Saudi Arabia signing away an even more valuable gift: nuclear technology. In a ceremony little-noticed in this country, Ms. Rice volunteered the U.S. to assist Saudi Arabia in developing nuclear reactors, training nuclear engineers, and constructing nuclear infrastructure. While oil breaks records at $130 per barrel or more, the American consumer is footing the bill for Saudi Arabia's nuclear ambitions.

Saudi Arabia has poured money into developing its vast reserves of natural gas for domestic electricity production. It continues to invest in a national gas transportation pipeline and stepped-up exploration, building a solid foundation for domestic energy production that could meet its electricity needs for many decades. Nuclear energy, on the other hand, would require enormous investments in new infrastructure by a country with zero expertise in this complex technology.

Have Ms. Rice, Mr. Bush or Saudi leaders looked skyward? The Saudi desert is under almost constant sunshine. If Mr. Bush wanted to help his friends in Riyadh diversify their energy portfolio, he should have offered solar panels, not nuclear plants.

Saudi Arabia's interest in nuclear technology can only be explained by the dangerous politics of the Middle East. Saudi Arabia, a champion and kingpin of the Sunni Arab world, is deeply threatened by the rise of Shiite-ruled Iran.

The two countries watch each other warily over the waters of the Persian Gulf, buying arms and waging war by proxy in Lebanon and Iraq. An Iranian nuclear weapon would radically alter the region's balance of power, and could prove to be the match that lights the tinderbox. By signing this agreement with the U.S., Saudi Arabia is warning Iran that two can play the nuclear game.

In 2004, Vice President Dick Cheney said, "[Iran is] already sitting on an awful lot of oil and gas. No one can figure why they need nuclear, as well, to generate energy." Mr. Cheney got it right about Iran. But a potential Saudi nuclear program is just as suspicious. For a country with so much oil, gas and solar potential, importing expensive and dangerous nuclear power makes no economic sense.

The Bush administration argues that Saudi Arabia can not be compared to Iran, because Riyadh said it won't develop uranium enrichment or spent-fuel reprocessing, the two most dangerous nuclear technologies. At a recent hearing before my Select Committee on Energy Independence and Global Warming, Secretary of Energy Samuel Bodman shrugged off concerns about potential Saudi misuse of nuclear assistance for a weapons program, saying simply: "I presume that the president has a good deal of confidence in the King and in the leadership of Saudi Arabia."

That's not good enough. We would do well to remember that it was the U.S. who provided the original nuclear assistance to Iran under the Atoms for Peace program, before Iran's monarch was overthrown in the 1979 Islamic Revolution. Such an uprising in Saudi Arabia today could be at least as damaging to U.S. security.

We've long known that America's addiction to oil pays for the spread of extremism. If this Bush nuclear deal moves forward, Saudi Arabia's petrodollars could flow to the dangerous expansion of nuclear technologies in the most volatile region of the world.

While the scorching Saudi Arabian sun heats sand dunes instead of powering photovoltaic panels, millions of Americans will fork over $4 a gallon without realizing that their gas tank is fueling a nascent nuclear arms race.

The FDA is currently debating whether to require a toll-free number and web address on all TV drug ads so we can easily report serious side effects to the agency.
But the FDA commissioner wants to study the idea for two more years. That’s too long! Prescription drug ads in magazines and newspapers already have this reporting information. Why not TV?

The benefits of making it easy to report serious drug side effects are clear:

• Better reporting of side effects will help the FDA do a better job of detecting dangerous drugs on the market sooner. Dangers often emerge only after millions of people start taking a drug.
• A recent poll found that only 7 percent knew how to report serious side effects to the FDA.
• The toll-free number and web address is already required in print drug ads; this would only put it on TV ads, so more consumers would see it.
An FDA panel convened recently to hear testimony on this, but now they need to hear from you.

Mobile phones could kill far more people than smoking or asbestos, a study by an
award-winning cancer expert has concluded. He says people should avoid using
them wherever possible and that governments and the mobile phone industry must
take "immediate steps" to reduce exposure to their radiation.

The study, by Dr. Vini Khurana, is the most devastating indictment yet published
of the health risks.

It draws on growing evidence -- exclusively reported in the IoS in October --
that using handsets for 10 years or more can double the risk of brain cancer.
Cancers take at least a decade to develop, invalidating official safety
assurances based on earlier studies which included few, if any, people who had
used the phones for that long.

Earlier this year, the French government warned against the use of mobile phones,
especially by children. Germany also advises its people to minimise handset use,
and the European Environment Agency has called for exposures to be reduced.

Professor Khurana -- a top neurosurgeon who has received 14 awards over the past
16 years, has published more than three dozen scientific papers -- reviewed more
than 100 studies on the effects of mobile phones. He has put the results on a
brain surgery website, and a paper based on the research is currently being
peer-reviewed for publication in a scientific journal.

He admits that mobiles can save lives in emergencies, but concludes that "there
is a significant and increasing body of evidence for a link between mobile phone
usage and certain brain tumours." He believes this will be "definitively proven"
in the next decade.

Noting that malignant brain tumours represent "a life-ending diagnosis," he adds:
"We are currently experiencing a reactively unchecked and dangerous situation."
He fears that "unless the industry and governments take immediate and decisive
steps," the incidence of malignant brain tumours and associated death rate will
be observed to rise globally within a decade from now, by which time it may be
far too late to intervene medically.

"It is anticipated that this danger has far broader public health ramifications
than asbestos and smoking," says Professor Khurana, who told the IoS his
assessment is partly based on the fact that three billion people now use the
phones worldwide, three times as many as smoke. Smoking kills some five million
worldwide each year, and exposure to asbestos is responsible for as many deaths
in Britain as road accidents.

Late last week, the Mobile Operators Association dismissed Khurana's study as "a
selective discussion of scientific literature by one individual." It believes he
"does not present a balanced analysis" of the published science, and "reaches
opposite conclusions to the W.H.O. and more than 30 other independent expert
scientific reviews."

Leave it to the tone deaf GOP to find a way of attaching themselves to this election cycle's "change" mandate that simultaneously reinforces the fact that their failed policies have messed up the world to such an inhuman extent that many Americans now live their daily lives in a state of free-floating panic and paralyzing anxiety.
In today's New York Times' Caucus blog, Carl Hulse reports that House Republicans have got themselves a brand-new slogan:
It looks like Republicans will counter the Democratic push for change from the years of the Bush administration with their own pledge to deliver, drum roll please, "the change you deserve." The first element of the party agenda developed over the past few months by the leadership and select party members will focus on family issues.

"Through our "Change You Deserve" message and through our "American Families Agenda," House Republicans will continue our efforts to speak directly to an American public looking for leaders who will offer real solutions for the challenges they confront every day," said the memo prepared for lawmakers.

What the GOP doesn't seem to realize, because they are idiots, is that "the change you deserve" is the registered advertising slogan of Effexor XR, a drug that many of you might have started taking as a result of all the...you know -- terrorism. (Hat tip to Bluestem for catching this gem.)
Effexor, also known as Venlafaxine, is approved for the treatment "of depression, generalized anxiety disorder, social anxiety disorder, and panic disorder in adults." Its common side effects are very much in keeping with the world the House Republicans have striven to build: nausea, apathy, constipation, fatigue, vertigo, sexual dysfunction, sweating, memory loss, and - and I swear I am not making this up - "electric shock-like sensations also called 'brain zaps.'"
Its less common side effects are equally awesome in their appropriateness.
And when the Food And Drug Administration reviewed the ad copy that included the tagline, "The change you deserve," it took issue with Wyeth Pharmaceuticals, which manufactures Effexor, saying that the company made "unsubstantiated superiority claims." Sounds like the GOP have picked an ironically accurate tagline for their efforts!

Anxiety disorders: House Republicans swipe marketing slogan.

We knew the National Republican Congressional Committee, its chair Tom Cole, and House minority leader John Boehner were not enjoying Congress like they used to when they had control back in 2006.

And their get-up-and-go had diminished to procedural games and time chewing motions to adjourn. Their gloom was so bad last week, the caucus by and large voted against Motherhood, as the WaPo reported.

Nonetheless, we were alarmed by the slogan for the minority caucus's re-branding campaign, for it directly addresses the depressed opportunities House Republicans might be feeling of late.

In the New York Times article, House G.O.P. Adopts Change Theme, we learn:

We think the slogan will only heighten the public's perception that the House Republican caucus needs help. After all, Americans have heard that slogan time and again.

Unfortunately, it wasn't pimped for political discourse, but to market an anti-depressant.

According to Wikipedia, the prescription drug "Venlafaxine is used primarily for the treatment of depression, generalized anxiety disorder, social anxiety disorder, and panic disorder in adults."

The brand name version, Effexor, is sold by Wyeth, which marketed it using the slogan, "The Change You Deserve™."

According to a December 2007 Alternet article, Are You One of Big Pharma's Lab Animals?, the drug company's ad agency came up with this marketing slant:

Wyeth's ad agency serenaded the nation with the message in its "The Change You Deserve™" campaign that, if we were not enjoying things the way we used to do, if we were lacking in what agencies used to call get-up-and-go, it was time to go on the antidepressant Effexor.

Are these symptoms of depression interfering with your life?

Not involved with family and friends the way you used to be?
Low energy, fatigue?
Not motivated to do the things you once looked forward to doing?
Not feeling as good as you used to?

We don't intend to make light of depression or any mental illness, for we've known far too many people who have suffered from them. Nonetheless, using a well-known shrug drug's advertising slogan for rebranding is unfortunate at best. A Freudian slip? Self-sabotage? Who knows. Somehow, we doubt the slogan for a red pill with "W" on it will help the GOP much in November.

"John Esposito is a name unfamiliar to many, but there are few people on the planet more deserving of general Dhimwit honors than this Catholic apologist for Islam, who is currently on the Saudi payroll at Georgetown University.

Just two years before 9/11, the second edition of Esposito’s book “The Islamic Threat: Myth or Reality?” was published. In it, the professor told a primarily American audience that the threat of Islamic extremism is overblown and that they actually have nothing to fear from the Religion of Peace.

Only in academia can being so fantastically wrong about something of such tragic significance actually be a boost to one’s career. Inexplicabley, John Esposito found his profile enhanced by the loss of thousands of innocent lives and has since devoted himself to trying to convince Americans that they are the real bigots. (This evidently delights his Muslim handlers, who find in his writings yet another excuse to put off introspection and reform).

This month, Esposito is promoting his new book “Who Speaks for Islam? What a Billion Muslims Really Think.” Not surprisingly, it is Esposito himself who speaks for Islam and, as such, the voice of a ‘billion Muslims’ sounds remarkably similar to his own. In fact, when it comes to U.S. foreign policy, Western values and the superiority of Islam, the resemblance between Esposito’s personal views and that of a “billion Muslims’ is downright uncanny.

Esposito bases his new book on Gallup polling, which has an objective ring to it at first – up until one discovers that the “Senior Scientist” on the cited Gallup project is none other than Esposito himself. Having the ability to influence the wording of survey questions yields some rather curious findings, such as the claim that Americans are three times more likely to support the killing of innocent people than are Iranians, whose country pioneered suicide bombings and whose religion fuels over a thousand deadly attacks on civilians each year.

As with his earlier (pre-9/11) effort, “What a Billion Muslims Really Think” is designed to play on Western tastes and convince readers that they have no reason to be concerned about an ideology with an explicit agenda of political and cultural dominance. Toward this end, Esposito either glosses over or ignores inconvenient details that might otherwise alarm anyone who is mindful of Islam’s irreversible creep into the West."

“...What a Billion Muslims Really Think” is really just an exercise in illusion – a parlor trick to fool readers into thinking that they do not see what they see. By stacking survey questions so as to yield preferred results, Esposito has the advantage of creating the very data to which he then refers."

PART FOUR ~
When truth seekers begin to open the veil of the crack between the worlds, we will see our memory circles.
Many of the leaders who are trying to keep us locked in the past, will not function today, will fall.
Many teachers and wise people will be seen for who they are and they will be the farmers, the labourers and the gas station attendants because the tagashala will be fully awakened.
People will begin to link up with other people in gathering together circles.
Many of these will be the so-called 'common people' and not the teachers you see up there now.

PART FIVE ~
The various winged serpent wheels will begin to turn, to dance once again and when they do the rainbow lights will be seen in dreams all over the world and these rainbow light dreams will help awaken the rest of humanity.
We will sit in a new circle of law.
All civil and social laws will have to be in conformity with natural laws or the people will not accept them and they will have the enlightenment necessary to reject those laws.
Science will once again become metaphysics. They will discover four laws that will help them jump to universal law and transcend the time-space continuum which is the limitation of the age and once again we will begin to take our power and to work with rules and laws that are cosmic laws.

PART SIX ~
We will once again see the way to continue a new dream.
We will be given the road map back to the stars and we will see the star people come out of the illusion of their two-legged form and into their actual great sleeper-dreamer form.
A powerful time approaches humanity and its really hard for me to talk about it.
I am a great dreamer but I don’t know if I dream that large.
We will see a real shift in planetary consciousness.
Many of the enemies of the humans will begin to drop away.
We will totally gain the light of the great light wheel.
There will be one humanity, one planet composed of all the different ways of dancing in complete harmony in the great gathering together circle.
All the seeds will be planted.
The Earth will have its true reality formed.
It will join the sisterhood of planets, the daughters of Copperwoman and it will create within itself all forms of all things in harmony with the everything.
We will see a whole new way of perfection.
There will be plants on this grandmother earth that will give life and sustenance as never before seen.
Starvation on the earth, all those things will be gone. There will be total balance and harmony.

PART SEVEN ~
The new race of humans will begin to design their new reality of life on this planet as they intended it to be when they first came here from the stars.
We will begin to establish this planet and use the collective consciousness to hold the power of this space in harmony with the Great Circle of Twelve and all the planets. There is a whole lot I don’t even know. There is more that I am not supposed to talk about yet.
The dream will be actualised and this planet will hold its space in the great council of planets and become a part of the universal enlightened sisterhood and brotherhood of humanity and keepers of the light circles. It's happened on many planets and it's expected to happen on a lot of other planets.
There will be a moment when the population will be 'the' Population, and something great will happen.
This planet will have its design of energy movement guided by all of humanity living here.

The Great Spirit will leave its seed and the egg of everything here on this planet and it will create itself 20 times over at the speed of light and this prophecy ends as I have been given it by the Grandmothers that I share with you now.

I hope many people will send the Vision of Freedom to friends.

I have been involved with the Rainbow Dream Vision of Hope and Freedom since 1984. In that year, three musicians came into my one-man printing and publishing office, and said, "You really must look at this." They seemed a little (funny how life is at times) like the three wise people bringing gifts. Two days later I was distributing copies at a conference, and like me, people were amazed and astonished.

That's when my life started to be 'larger than life'.
And, in 1987, I went to visit the Hopi in Arizona, North America.

As I drove in from the west, an older man sitting by the roadside waved down my car... later, it felt to me that I was expected. He took me to meet Qwa David Monongye, and in the evening I was taken to a ceremony in the kiva. A dozen or more men descended from a ladder in the roof, and formed up in an arc of a circle.

They faced one direction, towards one of the ends of the arc, and started a slow foot-shuffling dance. Then fairly suddenly, domino-effect, turned one-by-one 180 degrees to face the other end of the arc. At that point I very nearly fell off my chair ... something had hit me. A year or more later, thinking about it, the realisation seemed to be: 'We can change the direction the world is going in. It is possible.'

I drove off, eastwards, along the Hopi mesas to find somewhere to park up, and sleep the night. In the morning I got out of the car, and was surprised to see the face of the large rock only feet from the car had a carving on it. This was the Hopi's 'Prophecy Stone', and it shows people moving in a direction, and the path splitting into two. One path goes nowhere, it fades out. But the other path goes on, and corn symbols by the path indicate that this route leads to life and prosperity.

Many other unusual and significant things occurred out there in this ancient place where it feels like time had stopped. Indeed, after visiting the oldest township on the Hopi mesas ~ a tall, sharp-ended mesa, rather like a ship of the desert ~ my watch stopped, and never worked again. There is much more that happened.

In 1986 ~ the year before my first visit to the Hopi ~ I was within sixty feet of three disc craft, for around 25 minutes. This too, was like events were coming together to inform me of something significant, something much bigger than myself. In 1993, with friends, we were very close to craft in the area of the crop patterns of mid southern England on several occasions.

Since 1993, on most days when I first step out of doors I frequently see one or more flashes in the sky, seemingly from a source fairly close, and at a lowish elevation. I have always taken the flashes to indicate the locations of disc craft which are 'parked up' and are stationary. In 2007, possibly because I was loaned a camera with an unusual infra-red setting, many craft and aerial objects started to appear in my general scenic photographs. We hear so much folderol these days about Islam being a "peaceful religion." The fact is that Islam is anti-human and anti-woman - the most anti-human and anti-woman ideology on the face of the earth today. We need merely repeat a number of quotes from the Koran itself in order to prove these points. Anyone who claims the opposite is either willfully ignorant or despicably dishonest - and there are far too many people making such erroneous or deceptive assertions.

Let's start with the idiocy that Islam is "peaceful." The list of atrocities done in the name of Islam is VERY LONG and includes the ongoing torture of women. Let's proceed with the fallacy that Islam is "peaceful." Here is a quote from the Koran that puts to rest that lie once and for all:

I repeat, anyone asserting otherwise is simply ignorant or a purveyor of falsehood, to say the least.

The treatment of women within Islam is absolutely ABYSMAL - and is contrived to be so, through the manmade set of "laws" found in the Koran, a book with the psychotic qualities of the Bible but none of the "entertaining" stories. It is as if the writers of the Koran set out to chronicle the most atrocious concept of God ever developed. Here is what the Koran says about women:

"Men have authority over women because God has made the one superior to the other, and because they spend their wealth to maintain them. Good women are obedient." Q 4:34

I will not even go into the horrid mistreatment of boys within Muslim communities - it is a revolting aspect indeed. I have written about this awful psychopathy within Islam for many years, but many still do not know about it. Even though it is unfortunately not widely known, there is an unending epidemic of child abuse - specifically sexual abuse - within Islamic societies, starting, of course, with Mohammed's rape of his 9-year-old "bride."

These facts should not be let slip by lightly, as they are the root of much of the sociopathy we are facing with the encroachment of Muslim cultures in the U.S. and elsewhere. With that increase in the U.S., we also have record numbers of emergency-room visits by little girls with their genitals hacked off, a recent case of the psycho in Georgia who cut off his 2-year-old daughter's clitoris with a pair of scissors. Fortunately, this demented moron received 10 years - because female genital mutilation is illegal in the U.S., as it should be in any CIVILIZED country.

In my opinion, the spread of this fanatically violent and misogynistic ideology is a great threat that we all need to take very seriously. It does not bode well for the civilized world that the purveyors of barbarism are freely trampling over the term "truth." These individuals should NOT be allowed to get away with their spurious and disgraceful assertions but should be loudly called to the carpet.

For the majority of people, the drugs are no better then snake oil.

If the only problem was that, the drug is a placebo for the vast majority people who have been given it, I would not care.

But it is far from the only problem!

The Physicians' Desk Reference lists the following adverse reactions (side effects) to antidepressants among a host of other physical and neuropsychiatric effects: manic reaction (mania, e.g. kleptomania, pyromania, dipsomania), emotional lability (or instability), abnormal thinking, alcohol abuse, hallucinations, hostility, lack of emotion, paranoid reaction, amnesia, confusion, agitation, delirum, delusions, hysteria, psychosis, sleep disorders, abnormal dreams, and discontinuation (withdrawal) syndrome. Adverse reactions are especially likely when starting or discontinuing the drug, increasing or lowering the dose or when switching from one SSRI to another SSRI. Adverse reactions are often diagnosed as bipolar disorder when the symptoms could be entirely iatrogenic (treatment induced). Withdrawal, especially abrupt withdrawal, from any of these medications can also cause severe neuropsychiatric and physical symptoms. It is important to withdraw extremely slowly from these drugs, usually over a period of a year or more, under the supervision of a qualified and experienced specialist.

In addition to the adverse reactions listed in the Physicians' Desk Reference, the FDA published a Public Health Advisory on March 22, 2004 which states (in part): "Anxiety, agitation, panic attacks, insomnia, irritability, hostility, impulsivity, akathisia (severe restlessness), hypomania, and mania have been reported in adult and pediatric patients being treated with antidepressants for major depressive disorder as well as for other indications, both psychiatric and nonpsychiatric."

The vast majority of school and other recent massacres have involved people going on or coming off these drugs.

Many otherwise loving parents have killed their own children wile going on or coming off these drugs.

Study: 3 in 4 U.S. mosques preach anti-West extremism

Secret survey exposes widespread radicalism

An undercover survey of more than 100 mosques and Islamic schools in America has exposed widespread radicalism, including the alarming finding that 3 in 4 Islamic centers are hotbeds of anti-Western extremism, WND has learned [emphasis added].

The Mapping Sharia in America Project, sponsored by the Washington-based Center for Security Policy, has trained former counterintelligence and counterterrorism agents from the FBI, CIA and U.S. military, who are skilled in Arabic and Urdu, to conduct undercover reconnaissance at some 2,300 mosques and Islamic centers and schools across the country.

"So far of 100 mapped, 75 should be on a watchlist," an official familiar with the project said [emphasis added].

Many of the Islamic centers are operating under the auspices of the Saudi Arabian government and U.S. front groups for the radical Muslim Brotherhood based in Egypt.

Frank Gaffney, a former Pentagon official who runs the Center for Security Policy, says the results of the survey have not yet been published. But he confirmed that "the vast majority" are inciting insurrection and jihad through sermons by Saudi-trained imams and anti-Western literature, videos and textbooks.

The project, headed by David Yerushalmi, a lawyer and expert on sharia law, has finished collecting data from the first cohort of 102 mosques and schools. Preliminary findings indicate that almost 80 percent of the group exhibit a high level of sharia-compliance and jihadi threat, including:

Ultra-orthodox worship in which women are separated from men in the prayer hall and must enter the mosque from a separate, usually back, entrance; and are required to wear hijabs.

Sermons that preach women are inferior to men and can be beaten for disobedience; that non-Muslims, particularly Jews, are infidels and inferior to Muslims; that jihad or support of jihad is not only a Muslim's duty but the noblest way, and suicide bombers and other so-called "martyrs" are worthy of the highest praise; and that an Islamic caliphate should one day encompass the U.S. [emphasis added].

Bookstores that sell books, CDs and DVDs promoting jihad and glorifying martyrdom.

Though not all mosques in America are radicalized, many have tended to serve as safe havens and meeting points for Islamic terrorist groups. Experts say there are at least 40 episodes of extremists and terrorists being connected to mosques in the past decade alone.

Some of the 9/11 hijackers, in fact, received aid and counsel from one of the largest mosques in the Washington, D.C., area. Dar al-Hijrah Islamic Center is one of the mosques identified by undercover investigators as a hive of terrorist activity and other extremism. It was founded and is currently run by leaders of the Muslim Brotherhood. Imams there preach what is called "jihad qital," which means physical jihad, and incite violence and hatred against the U.S.

Dar al-Hijrah's ultimate goal, investigators say, is to turn the U.S. into an Islamic state governed by sharia law [emphasis added].

Another D.C.-area mosque, the ADAMS Center, was founded and financed by members of the Muslim Brotherhood, and has been one of the top distributors of Wahhabist anti-Semitic and anti-Christian dogma.

Even with such radical mosques operating in its backyard, the U.S. government has not undertaken its own systematic investigation of U.S. mosques [emphasis added].

In contrast, European Union security officials are analyzing member-state mosques, examining the training and funding sources of imams, in a large-scale project.

Some U.S. lawmakers want the U.S. to conduct its own investigation.

"We have too many mosques in this country," said Rep. Pete King, R-N.Y. "There are too many people who are sympathetic to radical Islam. We should be looking at them more carefully."

"Money On Trees"

Big cash nearly fell into Shunka Wakan's lap. Other Earth First!ers are kinda happy it didn't.

As the jury trial for the civil suit Kathryn Miller v. the Trees Foundation puttered to a start last week inside Courtroom 3 at the Humboldt County Courthouse, Shunka Wakan — a key witness for the plaintiff — spent mornings sitting on the hard wooden benches in the long hallway outside the courtroom. During breaks, Miller's attorney Linda Mitlyng, would come out of the courtroom to join him. But otherwise, as other people and their legal affairs swirled around him in a warm, odiferous bath of humanity, Shunka sat alone. Or, sometimes, he stood alone, straight-spined, his small, stocky body swallowed by the huge, stiff blue suit out of which his newly shorn, razor-scraped bald head poked vulnerably — as if, at any moment, the suit could gulp once more and he'd disappear completely. Always, he clutched a paper folder with a wolf's face on its cover.

The North Coast Earth First! Media guru had shaved off his woolly rust-tinged brown hair and beard the night before jury selection started, after discussing it with attorney Mitlyng. Now, it took an uncertain moment to recognize him. Then, of course: Shunka's light blue eyes in the pink-pale face, Shunka's closed-lip smile, Shunka's trademark husky murmur, "Mm-hmm, for sure," in response to a comment.

In Courtroom 3, the amiable but no-nonsense Judge Christopher Wilson's domain, the fate of a $185,000 donation dangled. Would the plaintiff, donor Kathryn Miller, prevail in her claim that the defendant, the Trees Foundation, was not in fact the intended recipient of her generous gift? That Shunka Wakan's NCEF! Media Center and the treesitters were? Or would the Trees Foundation convince the jury that, in fact, the money was intended all along for Trees, with no instructions attached for funneling it elsewhere?

In her opening arguments, Miller's attorney, Mitlyng, said the case came down to "fraud and broken promises." "She believed [Trees] would hold [the money] in trust, for the benefit of North Coast Earth First!" said Mitlyng. The defense's attorney, Richard Idell, countered in his opening argument that the donation was an unconditional gift and Miller never wrote letters of instruction — as Miller claims she did. "Ms. Miller ... didn't do anything. She took the check [from her mother's estate] and flipped it over and wrote on the back, 'Payable to the Trees Foundation,'" said Idell.

Miller's claim sought the return of her $185,000, plus interest.

Out in the hallway, Shunka waited to tell his side of the story. Maybe he thought about the magical donation that never materialized, and now probably never would. Maybe he thought about the other times he'd been in this courthouse — dozens of times, along with other activists, often before Judge Wilson, answering to charges of trespassing and other forms of civil disobedience in the woods. Likely, he wondered when they were finally going to call him in to testify — it was taking forever in there. He'd even sent out an e-mail prematurely to the several hundred subscribers to his NCEF! online group erroneously announcing he would be first up to testify.

By the end of Friday's court session, Miller was still on the stand. Perhaps Monday it would be Shunka's turn. Whenever it was, he would be testifying on Miller's behalf; but he wasn't a party to the lawsuit. And in the end, after hearing all of the evidence, the jury would be determining who was telling the truth about intentions and letters of instructions. Shunka was just there to provide context and evidence in a contract dispute.

But to a number of forest activists, including a half dozen or so who appeared in the audience last Friday to watch the trial unfold, that context matters more to them than the legal questions. They say this lawsuit has placed a strain on the environmental community that could do as much damage as an ill-felled redwood that takes down other giants in its descent. They disapprove of the lawsuit, and they blame Shunka for it. And, they say, it's just another example of how Shunka has commandeered the North Coast Earth First! identity and used it for purposes that nobody else in the amorphous but consensus-driven local Earth First! movement has agreed to.

"For a lot of us, when we read about the lawsuit, this is kind of like Shunka on trial," said long-time forest activist Deane Rimerman last Friday, calling from Olympia, Wash. "And, to what extent is he worthy of that money?"

Kathryn Miller wanted her money to go toward saving trees, she said on the witness stand last Thursday. The slender 59-year-old was dressed in a pink print skirt and white sweater, with her gray-streaked dark hair pulled back into a neat, thin braid tinted slightly green. (Little did the jury know that Miller had spent the night in jail, in blue jail duds, and then had been "dressed out," in court lingo, in her street clothes before being escorted into the court by the bailiff. Miller had been arrested the week before, on Sept. 17, when she arrived in civil court for the pre-trial readiness hearing; according to the misdemeanor criminal charges filed against her, Miller allegedly had made annoying phonecalls to Barbara Ristow of the Trees Foundation all hours of the day and night.)

On the stand, Miller described how she became an activist. She remembered how, when she was a child in Orinda, her mother decided to stop spraying the beautiful oak trees on their property after reading Rachel Carson's Silent Spring. "And then, when my son was 9, we were watching the news on TV about the Chernobyl nuclear power plant meltdown. And my son said to me, 'I wish I'd never been born. I don't think I'll get to live a full life.'"

She protested the building of the Diablo Canyon Nuclear Power Plant. She started a peace action group in the late 1980s in San Jose. She did nonviolent protests at the Nevada Test Site. And in 1990, she came up with some of her fellow protestors to help set up the camp for Redwood Summer, and to take part in demonstrations. She's been on and off involved in Earth First! actions in Humboldt ever since, she said, including huffing in supplies for treesitters and huffing out their garbage. She'd also, at one point, bought a condo in Arcata.

In 2004, Miller sold her condo and bought an acre of farmland, already planted with coffee, in Guatemala. She put in fruit trees to shade the coffee. That same year, her mother, who lived in Sonoma, died. "The last time I saw her was in 2003," said Miller. "She told me when she died, she was going to leave me some money. I told her I'd use it to further my work for the forest. And she was pleased, because she loved the treesitters and the forest."

Shortly after learning of her mother's death, Kathryn Miller sought out Shunka Wakan in front of the food co-op in Arcata, where he "tabled" to raise funds for the North Coast Earth First! Media office — selling T-shirts, and stickers, offering pamphlets, accepting donations. She'd known Shunka for about five years, she said.

"I said to him, I was going to inherit some money: What was the best way to get that to the North Coast Earth First!?"

In the spring of 2005, Shunka Wakan was floating above the treetops. "I was so excited," the 32-year-old said in an interview a few weeks ago, sitting inside his tiny but colorful North Coast Earth First! Media office in Arcata, walls covered in art and topo maps — including one of Buckeye Mountain, where in 2000-2001, during the "Mattole Free State" action, Shunka and others hiked 14 miles through waist-high snowdrifts to save trees.

Kathryn Miller, he recalled, had come up to him excitedly as he walked along the sidewalk outside the Arcata Co-op and said, "I just donated $185,000 to North Coast Earth First!'"

She'd talked to him the year before about making the donation — she'd said she was anticipating an inheritance from her mother's estate, and she wanted to make a big donation to his group. He'd told her to make it through the Trees Foundation, which handled the NCEF! Media office's finances through an arrangement that had been established years ago. (The Trees Foundation is an umbrella organization formed in 1991 to assist smaller environmental groups. As a 501(c)3 nonprofit, it can accept large, tax-deductible donations on behalf of affiliates, and provide professional resources. And it can lead large campaigns, like the one to save the Headwaters Forest back in the '90s.)

Well, now she'd finally done it.

Miller and Shunka agreed to meet at Fiesta Café in Sunny Brae, so she could tell him how she wanted the money spent: She wanted, straight away, for someone to organize a mediated workshop for the local Earth First! activists on ageism and sexism, issues she thought were fracturing the movement. And, she wanted the bulk of the donation to help support the forest activists who blockade logging roads and hunker up in ancient redwoods to fend off loggers' saws.

Not long after, Shunka was on his way to have lunch with some folks from the Trees Foundation, where they'd talk about Miller's wishes.

"Our media outreach was going to get a big boost," Shunka said. "The donation would keep the EF! office going for many years. So I walked into the Wildflower Café feeling elated, thinking we got all this money."

Barbara Ristow and Doug Wallace of the Trees Foundation were there. "I was super excited," Shunka said, "and I said, 'This is great, this big donation. Isn't it wonderful?' We ordered food, and still I'm all excited, talking about the money, but I notice they're looking nervously at each other. [Finally], they said, 'Well, we're just shocked that you think this money was for you.' And I was like, 'I just met with the donor, and that's what she said.' And they're like, 'Well, let's go ahead and plan the workshop and deal with that later.' I remember that, because it put me at ease."

After that, Shunka said he gave Trees a list of people he thought might benefit from the mediator-run workshop. "Some were people I knew had beefs with me, but I was willing to bring 'em into the circle and talk about it."

According to some vague accounts, the workshop was a disaster. One person who was there claims that Shunka, at one point, pounded his fists on the floor, blustered, then got up and stormed out, yelling as he walked away. Shunka says that's overblown.

"The letter from Kathryn Miller to Barbara Bristow said she wanted the mediation to be a safe place, safe to be emotional," he said. "And I think people are saying 'I freaked out.' The freak-out reports are exaggerated. It's just part of this ongoing character assassination. People say I was 'red-faced.' But my face is naturally red."

In late 2005, while Shunka was in Seattle, a friend called him from Arcata to say a woman had come by asking for the office key. She had a list of equipment she wanted to take away. The friend didn't give her the key.

When Shunka got back from Seattle, he discovered his reimbursement funds from Trees had been "frozen." He also learned about a letter someone in the NCEF! movement had circulated for signatures and then sent to Mark Knipper, who handled the Trees Foundation transactions for the NCEF! Media office. It said, in essence, "We don't want Shunka running EF!"

"I called the Trees Foundation," Shunka recalled. "I was sick, it was the middle of the winter, I'm trying to table, it's raining, it's cold. And Barbara Ristow told me, 'You just need to have a meeting [with the other Earth First!ers] and come to a group consensus on what the Trees Foundation funding should be used for."

The meeting never happened — nobody could agree to meet, said Mark Knipper, also in an interview last week. Knipper is a social worker and a long-time activist who had been the contact person between Trees and NCEF! Media. "So it ate itself," Knipper said. "And although I'm former Navy, a mariner, I said I'm not going down with this ship. So I divorced myself from it ... and signed it all back to Trees."

The NCEF! Media office was dropped from the Trees Foundation altogether.

Shunka and the NCEF! Media office never did see any of the big donation. Miller didn't even know that, he said, until she phoned him up in the summer of 2006, more than a year after she made the donation, to ask about a guy named "Jungle," who had been reported as missing on the NCEF! hotline. Miller was spending much of her time in Guatemala now, where she was raising fruit trees; after she'd made her big donation, Hurricane Stan had struck — she spent the ensuing year mopping up the mess.

First, Shunka told her Jungle was still missing. Then he told her about the money.

"I said, 'Yeah, they told me it wasn't for us,'" said Shunka. "And she said, 'I meant for all of it to go to you guys.' She sounded real upset. And I was like, 'I knew it! I knew it!'"

Shunka tried to sue Trees in small claims court, but it went nowhere.

Miller filed a claim against the Trees Foundation on Oct. 5, 2006, in Humboldt County Superior Court, seeking the return of the $185,000 plus interest so she could distribute the money herself.

And if she wins? "She may just spread it out more," said Shunka. "She's got tree planting ideas. Maybe she could buy a grove. She'd maybe not give it all to Earth First! this time. It was a once-in-a-lifetime opportunity that Trees blew for us."

On an uncomfortably hot afternoon last week, four forest activists who'd agreed to an interview for this story — Jeff, Shaggy, Sparrow and Farmer — sat on the ground at the Arcata Marsh next to a log bench on which a teeming crew of red ants worked a splintered notch. Someone had come along here in 1999 and carved a grouping of faces — bearded, grimacing, possibly mourning faces — onto the log and signed it Daniel. The carving had been drenched in red paint, and burnished by years of sitters.

"It kind of reminds me of the memorial for Gypsy," said one of them. "With the red paint."

Gypsy was the forest name of David Nathan Chain, who in September 1998, during an Earth First! action at Grizzly Creek, was crushed to death by a tree felled by an enraged logger. Farmer, actually, was there — he was just 16, but had a year of activism already under his belt. And Shunka was there — it was Shunka's first forest action.

Farmer, Shag, Sparrow and Jeff first made it clear that they spoke for themselves alone, although they participate in various forest defense affinity groups: Farmer works for the Mattole Wildlands Defense Group now, watchdogging the California Department of Forestry for new timber harvest plans, and keeping an eye on a Pacific Lumber Co. watershed analysis. Shag, who saw his first redwood about five years ago, helps keep the Fern Gully treesit village in Freshwater functioning. Jeff, who grew up in the high desert, and fell in love with the woods, works with the Nanning Creek treesit just outside of Scotia, as well as other groups. Sparrow, who was drawn to forest action because the cultural landscape was "like a folktale" he couldn't resist, is with the Fern Gully affinity group. These groups are all part of the Humboldt Forest Defense Association, a collective with a website but no formal structure.

The HFDA sprang into being six years ago — about the time the entity called North Coast Earth First! had essentially dissolved. It would take a book to describe that drawn-out dissolution — a book of lost causes, won causes, waning media interest, Judi Bari's death, Gypsy's death, ego-spurred squabbles, interpersonal catastrophes, a war overseas, hurricanes. And while the HFDA activists might still cherish the Earth First! name — the movement — in their hearts, it's now been further complicated by what you might call the Shunka effect.

"I still feel in many ways solidarity with the greater Earth First! movement abroad," said Farmer. "But in this county, in this climate, if you say you're with the North Coast Earth First!, many people associate you with North Coast Earth First! Media."

Shunka revived the North Coast Earth First! office around 2002. And he did what previous office managers had done — tabled, put out news releases, wrote articles for other publications. But it wasn't like the old days, in the '90s, when hundreds of people were getting arrested in forest actions and the jail support phone and legal resources were in constant use.

Shunka first worked in an office in Eureka, then later moved to Arcata. He called his outfit the NCEF! Media Center. For a time, he and other "affinity groups" tried to work together. But he alienated some people. He took over the North Coast Earth First! website. He controlled the North Coast Earth First! email list of 300 or more subscribers to the news alerts. He sent out press releases on his own.

"I felt the North Coast Earth First! Media Center was a unilateral effort on Shunka's part," said Farmer. Whereas, in the old days, "spokespeople were decided on by the group. And if you wrote an article it was passed by everyone. I feel Shunka appointed himself spokesperson at some point."

Many also claim they've been subject to a lashing anger from Shunka.

"I won't work with him because I pledge nonviolence in my actions," said Shag. "I don't believe he pledges the same thing. He has exhibited violent behavior towards me and towards other activists in my presence."

"He's a bear," said Jeff, making claw-fists with his hands.

But the sad thing is, all of this infighting probably has done nothing to help the actual trees. And the mediation workshop Kathryn Miller wanted didn't fix matters. Now, there was her lawsuit.

"When I heard about this lawsuit, I thought, the Trees Foundation does not deserve to be attacked in that way," said Farmer. "There's much bigger issues that need to be dealt with — with Maxxam and old-growth logging. ...If you look at Fern Gully and Nanning Creek (the Bonanza timber harvest plan), there's hundreds of old growth acres still standing whose fate is unclear."

Shag put it more bluntly: "If [Miller] knew Shunka and wanted to get the money to North Coast Earth First! Media, she should've given it to Shunka. But if she was trying to get it to treesits and forest defense, then the money went to the right place.

"My problem is this whole representation thing. There's people in the trees — how do you know who to get the money to, to help them?"

Shunka knows that a lot of fellow activists aren't happy with his role in the donation dispute. He also knows how some people talk about him and say he's hard to get along with. "I'm just standing up for the truth," he said. "And people don't like it. To me, it feels like a small clique of people who don't like me. I feel a lot of love and support in this community."

He certainly doesn't come off right away as someone who's angry, or who lashes out, or who locks the office and doesn't let people in. Why, recently, he helped a young woman hook up with the treesitters so she could learn the ropes. (Shaggy said that's proof Shunka doesn't have direct connections with the people doing direct action; but you can't deny it's a connection.)

It's probably a bad idea to ask Darryl Cherney, one of the founders of the local Earth First! movement, what he thinks of Shunka Wakan, whose real name is Jason Wilson. (Shunka tells a story of how he was named by a Lakota medicine man on the banks of the Cheyenne River in South Dakota in 1995. "Shunka Wakan," meaning "great dog," is only part of it. There's a secret part after that — altogether, his name means "the humble man called horse.")

"Shunka's a wingnut," Cherney said over the phone last Friday, sounding cheerfully vitriolic. "I have a 10-verse song about Shunka."

There's no other word for it but "mean." But Cherney and Shunka have history — not all of it sour. Cherney said Shunka laughed when he heard the song, at least the first time.

"I met Shunka in 1998," Cherney said. "And I know he knew Julia ["Butterfly" Hill, whom Shunka had come west to find]. That was a good thing, helping Julia. That was good Shunka."

Cherney had even pushed for Shunka to go to Houston to talk with Charles Hurwitz, whose Maxxam Corp. bought out the old Pacific Lumber company back in 1985 and quickly became the forest activists' number one villain. Shunka went.

But now? "The current status of Shunka and me," Cherney said, "is that Shunka has sent me five or eight or nine e-mails threatening to sue me. Shunka is a joke."

Cherney can talk for hours about the problems he's had with Shunka over the years. His main point, though, is what has Shunka done for the trees lately?

"My question is, where's your topo maps?" he asked. "Where's your wilderness preservation proposal? Where's your lobbyist team in Sacramento?"

It has to be that, on some level, even the people in the movement who don't like Shunka understand somewhat where he's coming from. So he's emotional. Passionate. Perhaps he's caught up so completely in the cause he can't let go. Or, who knows — maybe he's a phony, like he accused Knipper of being back in 2005.

But being a forest activist comes with perils beyond the obvious physical ones.

"I'm really trying to have compassion for Shunka, even though he's kind of attacked us," said Susy Barsotti by phone from Laytonville a couple of weeks ago. Barsotti is president of the Trees Foundation board, and she says the lawsuit has held Trees hostage, unable to function fully. "I've been mystified and dismayed that he's participated like this in the suit. But Shunka witnessed Gypsy's death. And I think he may have post-traumatic stress syndrome. I don't think he's recovered from it. And that can affect your behavior."

A number of people mentioned this, actually, about Shunka. And he often refers to Gypsy's death himself. In an article titled "What Luna has taught me," posted on the website of Julia "Butterfly" Hill's organization, Circle of Life, Shunka writes: "I decided to commit to doing ground support after witnessing the death of David Nathan "Gypsy" Chain on September 17, 1998 ... I remember looking across the valley as we hiked up that day, seeing the rolling hills of forests and clear-cuts, and thinking out loud, "That's why we're here!" Seeing Gypsy's life taken from him, and then seeing the corruption and lies of the Humboldt County Sheriffs ... really opened my eyes to the situation our old-growth forests face."

Later, he did ground support for Hill in her second year in Luna. And in the same article on her website, something else Shunka writes indicates how ready he was to devote himself to a cause: "Being on the support team was the top priority in my life, and I was happy knowing that everything else revolved around when I'd be needed for the next supply run. I never felt lost because I knew what I was doing. That was a feeling I had not felt in years, between feeling dissatisfaction with life in college, and then more dissatisfaction with life as a minimum-wage worker after college. Before joining Julia's ground support team I was unhappy, even to the point of tears, wondering if my entire life was going to be a minimum-wage nightmare ...."

Pure devotion, without benefit of a little hypocrisy, could drive anyone batty. Deane Rimerman, the activist from Olympia who said it is Shunka who is on trial, said it's not uncommon for intense, stressful movements like Earth First! to produce an army of walking wounded. And he's been around, in forest actions up and down the coast, for long enough to know; he was the one, in fact, who "got the maps and led the first hikers up to the hill" to the Gypsy Mountain campaign and Luna treesit.

"In the forest activist movement, there's very little that's rewarding," Rimerman said. "There's a lot of post traumatic stress syndrome. All of us get it. Once you've been through the court process, and the jail process, and seen 1,000-year-old trees get cut down that you really cared about and thought you could save — it's devastating."

That alone, setting aside the troubles with Shunka, could explain the many rifts that have occurred within the local EF! ranks over the years. Josh Brown, who moved to Humboldt in 1995 right before the peak of the Headwaters campaign, said one of the unique qualities of Earth First! is that it "is primarily a youth movement."

"A lot of people that come through are young, are passionate — and it's a wonderful thing," he said. They get thrown into leadership positions quickly — and then they get burned out. Many move quickly on to other things. Brown stayed in longer than most. "When I left [in 2001], I was 30 years old. And I'd been a full-time activist since I was 18."

Paradoxically, said Brown, the youthful draw and the departure of seasoned activists leaves the movement with "no elders to kind of sit around and coach the [new kids]."

The movement also draws strong personalities, he said. Tenacious ones, too, like Shunka's.

"Shunka, I think he really does have a big heart," said Brown. "And I think he does care for the forest."

Last Friday, following the morning session of Miller v. Trees, a group of the Humboldt Forest Defense Association activists stood on the courthouse steps talking. The door opened, and Shunka walked out and down the steps toward the group. They didn't greet him. After a time, he tried to talk to one of them, Jeff. Jeff walked away. Shunka followed him, then stopped and talked to another guy. Then he stood alone again.

"Trees Foundation Wins"

The jury in the civil case Kathryn Miller v. the Trees Foundation decided in favor of Trees, after deliberating all day Tuesday. (See "Money on Trees," Oct. 4).

Miller is the long-time forest activist who inherited a bundle from her mother and then signed $185,000 over to the Trees Foundation. In her lawsuit, she claimed she had intended the money to be passed through Trees to one of its affiliates, North Coast Earth First! Media, run by Shunka Wakan. She claimed she had made her intentions clear, verbally and in writing, and that Trees had agreed to the conditions, then broken its promise and kept the money. Trees denied making such promises, and said it had never seen any letters or heard of instructions to give the money to NCEF! Media. (Also, somewhat relatedly, in criminal court on Tuesday Miller pleaded no contest to charges that she had made annoying phonecalls to Barbara Ristow of the Trees Foundation.)

So, that's that. Now, there are only the pieces to pick up.

For Shunka Wakan — featured in last week's Journal as a central figure in a messy nest of infighting that has fractured the current ranks of local Earth First!ians — it could be a long, lonely patching together of lost friends and broken alliances. Not only did he and Miller lose their attempt to retrieve her donation, but now he's been banned from the North Coast Co-op.

Yes, that happened last week. It was Thursday, around 4:15 in the evening, and two activists with the Humboldt Forest Defense Association were tabling — hawking brochures and such — outside the Co-op. It's an activity Shunka himself has spent many a day doing in that very same spot, raising cash to pay for his NCEF!Media outreach work and other causes. And, well, these two fellows, Jeff and Farmer, were on Shunka's shit list, now. They'd spoken gently, but unfavorably, about Shunka's doings in the North Coast Earth First! arena — said he lashed out at people, said he commandeered NCEF! resources, and so forth. Here's a snippet of Jeff's account of what happened, which he sent to the NCJ in an e-mail on Friday:

"Shunka was removed from the Arcata Co-op yesterday after a scuffle with myself and another activist around 5 p.m. Well, he wasn't exactly removed, but APD was called. He was asked to leave after threatening to flip over the HFD donation table while stating he was 'like Jesus in the marketplace ...'"

Sue Coulter, manager of the Arcata Co-op, recounted on Friday how an employee walking by heard the argument and went inside to get her. "So I went out to talk to [Shunka], because it's not the first time we've had problems," she said. "Most of the time, he's fine. Most of the time, I stick up for him." One time, she said, she even called the police to protect Shunka after someone had threatened him. "But he gets into arguments. I tried to talk to him. I told him to leave. ... He was causing a scene, right by the door, and I can't have it. He refused to leave. ... I said, fine. I went into the store. He followed me into the store, and he was still yelling at me, 'Oh, now you're going to call the police on me.'" Coulter called the police, but Shunka left before they arrived.

Shunka, waiting in the courthouse for the jury verdict Tuesday, said Coulter did indeed ask him to leave and he did, indeed, refuse to. As for the HFD tablers, he said he merely asked them why they had Trees Foundation literature on their table. "I said, 'Why do you want to represent these people?'" And then, he said, "Jeff accused me of embezzling — he said this in public. He said, 'You've embezzled thousands of dollars from the Earth First! movement through the years.' And I complained to one of the employees who was walking by. Because that's serious, accusing someone of embezzling."

But Shunka said the whole thing's yet another attack on him. "I don't consider I was yelling. We were talking. I'm an emotional person, I concede to that. I speak from my heart. I don't scream at people. I would love to — but I don't."

In his email, Jeff with HFD predicted Shunka would leave town within weeks, if not sooner. But at the courthouse, even before the verdict, Shunka said he wasn't going anywhere.

"I'm just going to continue to run the Earth First! office and continue to call Humboldt County home," he said. He's also going to write a letter to the Co-op, complaining about how he gets scapegoated and booted out of there even when other people, he says, are the culprits. And, as for the Miller v. Trees case, he said, he and Miller may now take their complaint to another venue.

“WASHINGTON (AFP) - Immigration will drive the population of the United States sharply upward between now and 2050, and will push whites into a minority, projections by the Pew Research Center showed Monday.

“If current trends continue, the population of the United States will rise to 438 million in 2050, from 296 million in 2005,” an increase of nearly 50 percent, the study by the Washington-based think-tank said.

More than 80 percent of the increase will be due to immigrants arriving in the country and their US-born children, who will make up nearly one in five Americans by 2050 compared with one in eight in 2005, it said.

Whites, who currently make up around two-thirds of the US population, will become a minority (47 percent) by 2050, the report said.

The Hispanic population, currently the largest minority group, will triple in size and double in percentage terms from 14 percent in 2005 to 29 percent in 2050, the report said.

The Asian population will roughly double in percentage terms, from five percent to nine percent, while the black population will remain static at around 13 percent.

The projections are based on trends over the past 50 years, during which legal and illegal immigration have played an increasing role in US population growth, the report said.

From 1960 to 2005, new immigrants and their US-born descendants accounted for 51 percent of population increase, and for 58 percent from 1980 to 2005, the report said.

But, the report warned, “possible future changes in immigration policy” could impact the projections.

Illegal immigration has become a top issue in the race for the US presidency, especially among Republican candidates, most of whom favor of a crackdown.”

Marc Emery is called the 'Prince of Pot' and claims to have sold more marijuana seeds than anyone in the world. To date, no one has disputed that claim. He lives in Vancouver, British Columbia, he is the founder of Cannabis Culture magazien, and considered by the U.S. government to be the biggest drug kingpin in history.

Just days before embarking on his 16-city 'Farewell Tour Across Canada' (and a few short weeks before entering prision for a 10-year stay), Marc was nice enough to sit down and take Time 4 Hemp.

A Roadmap for Demonstrating Presidential Credibility on One of America’s Most Important Issues

I. SECURE THE BORDER

1. Border Fence and National Guard: If elected President, will you secure the border, including completing construction of the 700 mile southern border fence required by the Secure Fence Act, constructing more miles if needed, and keeping the National Guard on the border until it is secured?
□Yes or □ No

2. Border Prosecutions: If elected President, will you deter illegal entry by expanding the already successful Zero Tolerance Prosecution Policy (Operation Streamline) from 3 to all 20 border sectors, and support statutory mandatory minimums for the crimes of illegal entry, reentry, and reentry after deportation for any felony?
□Yes or □ No

3. Control Visa Overstays: If elected President, will you give our immigration system integrity by completing the 10-year past due exit portion of The USVISIT (Visitor and Immigrant Status Indicator Technology) system and eliminate other weaknesses in the system so that future visa overstays can be identified?
□Yes or □ No

II. END THE MAGNET AT THE WORKPLACE

4. Enforceable Employer Verification System: If elected President, will you end the jobs magnet by requiring all employers to use the electronic verification system to check the legal status of all employees, reduce fraud by decreasing the number of documents employers must accept to prove legal status, and will you offer cooperating employers a safe harbor?

5. Biometric ID Card For All Non-Citizens: If elected President, will you require a biometric (fingerprint encoded) identification card for all aliens authorized to work?
□Yes or □ No

6. Eliminate Identity Theft: If elected President, will you increase security for legal workers by requiring social security earnings statements to list all employers reporting wages under an individual’s social security number so that fraudulent use of that number can be spotted and will you fight to keep using "no match notices" as evidence that employers knew they were employing an illegal alien under a social security number issued to someone else?

III. STATE AND LOCAL LAW ENFORCEMENT

7. Form Effective Partnerships: If elected President, will you form effective immigration enforcement partnerships with state and local law enforcement by clarifying their authority to enforce federal immigration laws, deputizing state and local officers in every state (through the 287(g) program), offering a basic training course for all state and local officers, and compensating state and local entities for immigration enforcement related expenses?

8. Federal Response To State And Local Arrests: If elected President, will you promptly evaluate the 27% of prisoners that are non-citizens so that illegal alien criminals can be processed and deported at the end of their sentences, and will you implement a mandatory federal response to state and local law enforcement when they apprehend an illegal alien for a DUI, child abuse crime, or any felony?

9. End Catch and Release: If elected President, will you put an end to the existing policy that allows illegal aliens caught inside our country to be released on bail after their arrest while they await their initial court appearance?
□Yes or □ No

10. List Illegal Aliens In the NCIC: If elected President, will you immediately expand the National Crime Information Center’s (NCIC) Immigration Violators File to include: (A) aliens against whom a final order of removal has been issued; (B) aliens who have signed a voluntary departure agreement; (C) aliens who have overstayed their authorized period of stay; and (D) aliens whose visas have been revoked?

IV. DISCOURAGE SANCTUARIES

11. Deny Federal Funds: If elected President, will you encourage compliance with Federal law by implementing a reduction of at least 10% of discretionary federal grants and highway funds to cities, states, universities, and other entities that undermine Federal law by implementing sanctuary policies, issuing driver’s licenses to illegal aliens, or offering education benefits to illegal aliens (such as in-state tuition) that are not available to all legal residents and citizens?
□Yes or □ No

12. Close Financial Loopholes: If elected President, will you rewrite the Treasury regulations to close the loophole that allows illegal aliens to open U.S. based bank accounts?
□Yes or □ No

V. IMPROVE THE LEGAL IMMIGRATION PROCESS

13. Replace Visa Lottery and Chain Migration with Merit Based Immigration System: If elected President, will you eliminate the visa lottery program and change current preference categories that guarantee automatic entry for aging parents and extended family members and replace it with a system that fairly and objectively evaluates at least 50% of applicants based on characteristics such as education, skills, English ability, and age?

14. Pathway to Citizenship: If elected President, will you take a pathway to citizenship for illegal aliens off the table?

15. Seek Necessary Authority: If elected President, will you ask Congress for necessary laws or funds to execute these commitments?
